Justice Brennan was a recess appointment. It lasts for the session unless ratified by the Senate only 51` votes!! Then it is LIFE!! DO IT!!

Once the recess appointee’s term has expired, can’t they still be put up for nomination?

There has to be some rino jerk that’s hiding behind Chuck U Schumer’s filibuster.

1. If the Democrats block an appointment with a filibuster and McConnell doesn't change the Senate rules, then the nomination is going to be in jeopardy.

2. If that happens, then Trump has the opportunity to wait until the Senate is in recess and then make a recess appointment that will sit on the Supreme Court for 1-2 years.

3. A nominee who accepts this appointment is not someone who is likely to give up an existing legal career to take this position unless they are very old already.

So here is my suggestion for President Trump ...

If the U.S. Senate blocks your Supreme Court nominee, wait until a Senate recess and then make a ridiculous appointment like a retired pro wrestler to sit on the Court for 1-2 years.

I hear your concern, but I base my prediction on Ryan caving and agreeing to pre-fund the WALL. I think they’ll realize that fighting Trump this early is futile, quite soon.

In my opinion, conservatives, Republicans and libertarians should hold ground and NOT give in while the fervent energy is present.
Take advantage of this energy and recreate the Constitutional Republic, which we are.
All this talk about a democracy is nonsense for a reason.
Democracy is two wolves and one sheep deciding what’s for dinner.

Recess appointment : Clint Eastwood. REALLY make their heads explode. Then back Clint up with a rock-solid consetvative team of law clerks to do the real work.

No, just make them do a real filibuster, not just say they are filibustering. The Republicans never make them do it, they just fold to the threat.
Make them do it, it will end and then they vote, Democrats lose.

Not true. The SC nominee needs 60 votes to be confirmed and if he/she does not get 60 votes, they aren't confirmed.

The reason is that it takes 60 votes to stop debate and if there are not 60 votes, debate can go on forever. The interesting thing, once the 60 votes are achieved to stop debate and vote on the nominee, it then takes just 51 votes to confirm the nominee.
