We began discussing this last night when the tragic news broke about the death of Justice Scalia, and as predicted the question has caught fire already. The President already said he will be nominating someone, but will the Senate take up the question while he is still in office? We have the answer from several presidential candidates already and one of them is Jeb Bush. It's really not that important to him.

JEB BUSH: I think President Obama is going to submit a nominee and in all likelihood this person will be out of the mainstream and he'll be rejected by the Senate. That's his prerogative. He has every right to do it, and the Senate has every right not to confirm that person. That's what I said. He clearly has the power to do it, but given his choice of Supreme Court justices in the past the Senate of the United States should not confirm someone whose out of the mainstream.
DANA BASH: But if I could just clarify, right now it sounds as though...
JEB BUSH: Yeah.
DANA BASH: ...the Republicans who run the Senate aren't even going to schedule a vote. You think that one should be scheduled?
JEB BUSH: It's up to Mitch McConnell. That's really not important to me....

With this senate? Do you think Obama could not buy off a few of the worst of the RINOs at firesale prices? Just hole it up in the judiciary committee. Put it on ice - not put some ice on it. Any vote is dangerous.
Agreed. The Dems only need four Republican votes to put get a judge confirmed. How do you think McCain, Graham, Kirk, Collins, Murkowski, or Cornyn will vote? Obama would be a fool to make a recess appointment here. He knows he will get what he wants if it goes to a vote.
And even worse, there is a chance the Dems could gain Senate seats in the November election. Obama will have two weeks after the new Senate is in place to push a vote. With 24 GOP Senate seats up for grabs and only 10 Dem seats, he has got to like the odds. The only hope we have is if McConnell refuses to bring it to a vote. Scary, I know. But McConnell may be our only chance.

He can keep it bottled up in committee until next year if he wants.

Jeb, you just answered why the base is not voting for you or any rino.
They’d need 14 GOP votes. The filibuster still applies for SCOTUS nominations. Even with the expected takeover by the dems in the Senate this year, reaching 60 votes would be an extremely tall order.

How did Jeb go from being a pretty good governor to...such an absolute weasel? What is going to do next? Ask his mommy to help him? Oh, wait...

This isn’t the first time something hasn’t matter to him in the past few weeks. Teri wasn’t important to him, either.
Harry Reid (or Schumer) would simply suspend the filibuster again, as they did in the 2014 lame duck, when they packed the Circuit Courts with leftists, which now will come home to roost, with a 4-4 SCOTUS
I think Caitlyn Jenner should be the nominee. We don’t have a transgendered, wise, TV reality show ex Olympic gold medal winner on the bench yet.
