Obama declares DOMA unconstitutional, continues "evolving" on gay marriage

As you've no doubt already heard, the Obama administration announced today that the President now views Section 3 of the Defense of Marriage Act as unconstitutional; the administration will stop defending it in court. That, of course, is the section holding that for federal purposes, marriage is defined as only between a man and a woman.

Does this mean the president now favors gay marriage? At today's press availiability, White House press secretary Jay Carney said he doesn't:

"I would refer you to just to his fairly recent statements on that. He is grappling with the issue. But he -- again, I want to make the distinction between his personal views, which he has discussed, and the legal decision that was made today."

Obama recently said his position on the issue is "evolving," so Carney's quote appears to mean that it still is in that mode.

That said, the President's determination that Section 3 is unconstitutional is unquestionably a welcome act of leadership on his part.....

Since when can a president declare any law unconstitutional? Isn’t that the purview of the SCOTUS?

Might as well. I've already picked out the tax and murder laws I don't want to obey unless I really, really, really want to ~ but, my ideas are evolving!

Frankly, no one at Free Republic is at all surprised that Obama is finally coming out.

Congress has stood by and let the Obama administration essentially assume the power of all three branches of the Government. It’s only going to get worse.

Totally incoherent is right.

If Obama seriously believes that distinctions between same sex couples and married couples are unconstitutional he hasn't done nearly enough. He should announce that he won't be enforcing DOMA and issue an EO requiring all federal benefits available to married couples be equally available to same sex couples who get a certificate of marriage from one of our loopier states. He took an oath to uphold the Constitution and if he truly believes the Constitution requires the abolition of marriage he is duty bound to abolish marriage.

Of course he won't be consistent because he knows that would be political suicide — gutless wonder. I suspect he'll be surprised just how much political damage he's done himself just by announcing that marriage is irrational. And you thought it couldn't get any worse than proposing to try KSM in NYC.

Well, I can think of a lot of laws that I don’t agree with, either - so, I’m just going to ignore them. I might just ignore some just for the heck of it. I have exactly as many votes in this as he does.

I actually do have 19th and early 20th century anarchists in my family tree, and my mom was terrified when I actually (with safety scissors) cut off the “do not remove under penalty of law” tag from my first mattress!

The holder of the Office of President is not the one entrusted with the determination of the Constitutionality of any law, although some are self-evidently unConstitutional, and should be vetoed as a result.

You are absolutely correct. With this kind of logic, Obama can just start making it up as he goes. An election every 4 years? Unconstitutional in his eyes. Obowow may declare himself president for life by Friday.
