By the time Lincoln intitiated the blockade Virginia and North Carolina on April 27, Virginia had already adopted their Articles of Secession, Robert Lee had been appointed to command the Virginia state forces, and both North Carolina and Arkansas had seized federal facilities. Any acts of war had been committed by the southern states not the Lincoln government.

"This ordinance shall take effect and be an act of this day, when ratified by a majority of the voter of the people of this State cast at a poll to be taken thereon on the fourth Thursday in May next, in pursuance of a schedule hereafter to be enacted."
