Because the DA is up for re-election against sagging poll numbers, and he needed a high profile death penalty case to win. Westerfield is a scapegoat. I have followed the trial on and off on thesandiegochannel.com live feeds, and would vote for aquital. There is more than a few degrees of doubt in this case.

* 'Cause he left his hose out across the yard, and a "neat freak" just wouldn't do that.
* 'Cause he's divorced and lives alone since Susan moved out.
* 'Cause he went on a pre-planned, typically meandering desert trip that weekend, by himself since none of the other people he invited to go with him could make it.
* 'Cause he was "overly cooperative" by letting police look in his house and talking to them about his whereabouts that weekend.
* 'Cause he looks "creepy" (as per Duh-knees, who danced with him and rubbed her body all over him in the process).
* 'Cause he wasn't attracted to Brenda, but rather asked about hookin' up with her gal pal Barb.
* 'Cause The Bren pointed police in his direction mere hours after they arrived at the Van Dam household looking for Danielle.
* 'Cause some of the neighbors didn't like his motorhome.

Lots of reasons, actually. Just screams guilty!!!, doesn't it?

That is exactly the question that those of us who don't think that the state has proven their case against Westerfield would like to have answered.

There is some question that the father, Damon Van Dam, was not completely cleared as a suspect before Brenda pointed to Westerfield. For instance, Damon was known to have been driving his Blue van (possible source of blue fibers?)near the Dehesa road site, just days before the body was discovered, despite the fact that the police had ordered him not to enter in the search for the body. As a matter of fact, it was Damon that pointed the way to the searchers, asking that they search closer in, even though the area had already been searched.

Maybe they did not want to look?

I read that the detectives didn't gather evidence right . It seems they didn't take pictures as they should have before they cut the squares from the jacket and the rug.

Maybe they are trying to cover up their icompetence? Maybe one of them did it and is trying to frame him?

The little I have read that they have on him doesn't even add up to an indictment.

Westerfield was never placed in the house. But maybe she wandered outside and he grabbed her there. But they are saying he went into a house and took her, leaving no prints and she didn't have any either.What is going on here?
