Agreed -- it's not consistent with child porn, which had been deleted off the hard disk, BTW.

The general consensus among the media nitwits here in SD ( I listen to a variety of stations on my drive in to work) is that there is NO WAY the jury could come back with not guilty. Most seem to think it will be a hung jury.

This is not a personality contest. This is a pursuit of the truth. If there is anything *I* have done to offend, please don't hold it against Mr. Westerfield.

Now, I am going to address that there is no evidence of DAW in the Van Dam address. Prosecution's theory, Stealth Ninja Dave (not in those exact words). Somehow Mr. Westerfield came in apparently through the side door. Snuck in, left no fingerprints, no physiology, no trace, and somehow knew that the door that was closed was unlocked.

Westerfield later deleted these images. Those were what he didn't want.

After viewing all of those attack videos, some as many as five times.

Vengeance is not what we're after here, but justice. We are obliged to see justice done in this life.

They're saying that, mysteriously, Mr. Westerfield crept in through that door (the one Duh-Knees said she closed). Everybody else's house, you walk in through the garage and there's a double lock. Not in this house. The lock was on the outside. There's no proof, there's nothing but speculation. Somehow, Westerfield realizes that the door that is probably locked is open, and he goes in.

What is your PROOF that he "sought these images"? You have NONE.

The fact that he stored the attack videos in a special folder in his work folder on the computer and that he made special cd's and zip disks storing up the images he wanted.

This is a man who is supposed to be drunk. But even if he were sober it wouldn't matter. It's completely dark. It's pitch black. In one spin on the evidence (Brenda) there is light, the tv is on upstairs...in another spin it's pitch black. If you're standing on the street looking in, it doesn't matter if the blinds are open or shut, you can't see in. So in the STEALTH, in the dark of night...we don't know? Somehow Mr. Westerfield has the ability to figure out, without ANY evidence whatsoever, no hair, no fingerprint, no nothing, he walks around, goes to the stairway.

And somehow he goes up the stairs. No noise. Nobody calls out? Up the stairs this man goes. They've got a fingerprint on the bannister. But guess what? This man has been excluded. Everyone who the Van Dams said had been in that house has been excluded.

Up the stairs he goes, in the dark. He looks to his right, it's dark. He looks to his left, there are three bedrooms.

How did he know which door ? Answer, whoever took her would not have been heard. If they could enter one childs room, they could enter the other.

He looks down that hallway, and this is what he sees? Doors. He doesn't know whose door is what. He's never been in there! Good guess. Their theory. Their theory requires you to believe beyond a reasonable doubt that this is what happened.

Mr. Dusek said yesterday that he can't tell you what happened...he's just guessing. But somehow, on Dusek's theory, David Westerfield, all 6'2" of him, sneaks in to the door that Brenda testified she closed when she put the kids to bed. No sound. So he sneaks in. Must be really, really careful not to leave any fingerprints.

So he sneaks into the bedroom, then -- Whoops! In comes Brenda. And in comes Rich and Keith and Denise...so he closes the door. Brenda and the girls go up to the master bedroom.

If Feldman keeps up this good, and he has only been at it aprox. 15 min., he is going to put reasonable doubt in at least one juror's mind.
