Judge William D. Mudd admonishes the media about attempts to photograph Neal Westerfield, son of defendant David Westerfield, as the son left the courtroom during a break in his testimony Wednesday afternoon, July 24, 2002, in San Diego. The judge had ordered the media not to film the teen. David Westerfield is accused of the kidnapping and murder of 7-year old Danielle van Dam from her home in February. (AP Photo/Pool, Dan Trevan) |

I hope they do as well, however, I think the SDPD and DA are not interested in exploring the possibility that Avila and the other pervs may be connected to Danielle's abduction and murder. Too much invested for Pfingst in DW's trial. If it turned out that the others were involved, the judge wouldn't be the only one whose name is "mudd".

Which could also make it very old.The orange fiber tangled in her hair? The witness was allowed to testify that her opinion, based on knowledge of fibers and how they transfer and stick around, was the fiber came to be there at or very near the time of death.
I'm just posting the testimony...FWIW.

It does look hinky. An appeal? A conviction getting overturned? Or maybe if the jurors actually look at the testimony and follow the law, it guarantees an acquittal?
Recently I was talking to a 20+ year veteran on HPD about this case. He made a passing comment about how many innocent people are in prison. He laughed at my naivete and assured me that it was true. He said that sometimes it's just literally a matter of being in the wrong place and sometimes they decide it's you and then it's too late.
Prior to that conversation an atty at work was passing by and overheard a conversation with a co-worker about justice. He stopped and laughed and said that I was foolish to think that there was true justice in the system.
Shot down in flames...
My last 2 illusions, shattered. Maybe I should quit being jaded and just be harborsnoillusions?

I really don't know what to think...if they didn't run that hair thru the offender database in an ongoing investigation...I'm not sure they will now.
Hopefully, if anything at the Runnion recovery scene remotely resembles the VD scene...someone will do something.

That is the sad possibility...that politics and ego will trump justice.

The fiber was tangled in a clump of her own hair...on a necklace that she "never took off", according to her own mom's testimony.
Again...there's no source given...could have come from anywhere.

The dog did bark. I heard it, I also heard the alarm beep. It's very loud unless Brenda was standing right under it, which I doubt.
Wonder if they will source that hair now?

Thanks Fres. Girls just want to have fun, huh? Did the jurors get to hear this little tidbit? Never mind I think I know the answer. This makes me more convinced as ever that the VD's are truly evil people. Poor Danielle.

I have been simiarly convinced for months...but, may be seperate from trial outcome..who knows...

Very interesting. This case has forced me to rethink alot of my beliefs about the justice system.

Exactly. So for the prosecution to say that DW DEFINATELY killed Danielle, based on a few fibers with no source, and DNA spots that can't be "time-tested"...is premature and irresponsible.
We know the odds of Danielle being in the MH are better than average, BUT, since the prosecution can't determine WHEN she was in the MH, their case is resting purely on circumstance.

Sorry fres, memories of past.. I put it on the missouri list and pinged a few folks. haven't had time to do much else yet. will see if there is a local news update. Thanks..

Hi Spunky;
I believe the new neighbor,McNally said the van Dams and Danielle was over on Friday,Feb. 1 to sell him GSC. The vD's never testified to this(not that I saw anywhere tho),but the neighbor had no reason to lie about the day. Then McNally said PDvD came running over the next morning,Feb.2 to ask if he had seen Danielle because she was missing and was known to sleep walk.(?) Then later when asked about the sleepwalk it was turned into a "pottie dance" in the MB. I guess the vD's forgot about the cookie sale Friday evening to the neighbor. Since PDvD didn't arrive home from work until 6:30pm Friday the cookie sale must have been after the family had pizza.........Brenda left with the friends for Dad's about 8/8:30pm Friday night?
