The prosecution didn’t present evidence that was beyond a reasonable doubt that she had done so. With a hung jury at 11 to 1 for acquittal last time, you’d expect the defense to present a much more aggressive stance at the 2nd trial, if there is one.
Lazy prosecutors built the case around her confession, which may be invalid because of her mental condition, and didn’t build the rest of it.
The state should do a stipulated agreement with Clancy in which she is remanded to a hospital for the criminally insane for the rest of her life. That gets here where she needs to be.
