Justice Department Sues San Jose for Unconstitutional $1600 Firearm Permit Fee

Today, the Justice Department filed suit against the City of San Jose, California, and the San Jose Police Department for charging private individuals unreasonable fees to exercise their Second Amendment right to lawfully carry a firearm. At nearly $1,600 per license, the City’s application fee to carry a firearm is the highest in the nation. Indeed, San Jose’s fee towers over those imposed by the country’s biggest cities. New York, Washington, D.C., Boston, and Chicago all charge a small fraction of San Jose’s fee. The Supreme Court has held that “exorbitant fees” such as San Jose’s violate the Second Amendment because they deny ordinary citizens their right to carry firearms for self-defense.

"All law-abiding Americans have a constitutional right to bear arms for self‑defense. This right is not a luxury reserved for a privileged few, but a fundamental element of our republic,” said Assistant Attorney General Harmeet K. Only an Idiot would get the permit for SJ. The county, while still backed up, is more reasonable on the fee and not restricted to living in SJ.

SJ also requires you have firearm insurance(with all listed weapons, all provided to the city) for your house. Which is unenforceable unless you do something stupid like get the city permit

Sues? It’s a Rights issue. Send in the troops. If a southern state charged a poll tax or local LE allowed lynchings would the Dems file and wait for a lawsuit?

The best historical analogy for this huge firearm fee is the unconstitutional poll tax that Dems used to like. The basic idea is to tax people out of their constitutional rights.

Typical CaCaLand behavior. Only celebrities and politicos get a carry permit. And then, only thru a local sheriff. 1% chance of a normie getting one.
Fees are astronomical and tests intended to just waste your time — you get rejected in the end.

We used to be able to open carry. But, decades ago some uppity blacks showed up with long guns outside a courtroom in protest. In the same day the Democratic politicos in charge outlawed carry of any type.

This is typical “starting a conversation” law, which translates to “let’s see if we can get away with it” so beloved of leftwing activists. They know perfectly well they can’t, but the attempt is at no cost to them because the taxpayers they’re attempting to abuse are also the ones paying both for the attempt and the defense.

Having lived near San Jose for almost 20 years, I’m pretty sure they “Charge” 1,600 to apply, reject the application and then keep the money.
