PLYMOUTH, Mass. – A judge declared a mistrial in Lindsay Clancy’s murder trial Friday on the seventh day of deliberations — but gave her defiant lawyer one hour to file an emergency appeal against the ruling.
The 12-person jury – made up of nine women and three men – told Judge William Sullivan that they could not agree on whether to convict Clancy, 36, of three counts of first-degree murder.

The judge gave the defense an hour to file the appeal.
The defense lawyer is just wasting everybody’s time.
The odds of it being successful are slim and none....and slim just left town.
I’m sure he factored that in his decision. He took a beating in the jury room for a week. They possibly threatened him as well.
After listening to all the evidence, the arguments of the State and the defense, and being instructed in the law by the judge, right?

I don't fully know the rules, but I served on a 6-person jury in a civil cast in Florida. When it was time to deliberate, the judge released the one alternate juror. (We had no idea who the alternate was until he was released.) At that point, he left and so became "contaminated" by outside influences, so I'm not sure how an alternate could be called back.
Her lawyer is a proper a-hole.

I agree. It’s just delaying the inevitable. About 20 minutes now and counting down from that hour.
I fear for that juror’s life.
We should find out soon who was the one holdout and what that person was holding out for compared to the position of other eleven.
It’s different when Jake Tapper and CBS evening news shows your face and name and calls you a pig versus Facebook communities.

I didn’t see it. Given the extreme ignorance and sloppiness with which media, left, right and center, covers legal issues, I doubt reading any articles would help.
Based on what I’m seeing, I think this is what has happened: one does not seek permission to appeal. This would not be an appeal, it would be a writ— simplified, call it an extremely expedited appeal of a single issue. What is reported as the judge “allowing” is him agreeing not to discharge the jury and release them from confidentiality pending determination of the writ application. If the jury were discharged they could not be reconvened
