n August 9 in Short-barreled rifles are finally legal—sort of—maybe… I wrote about a recent decision by a Texas federal judge striking down portions of the 1934 National Firearms Act. That act was written under congressional taxing powers, but when President Trump’s Big Beautiful Bill eliminated that tax for NFA items, the lawful basis for requiring registration of short-barreled rifles, short-barreled shotguns, and suppressors vanished. In effect, the constitutional basis of the NFA disappeared.

The catch is the judge’s injunction, which hasn’t yet been appealed by the DOJ but might be, applies only to the parties to the suit and certain manufacturers and dealers in those states that were parties to the suit. The Supreme Court has ruled out nationwide injunctions by activist leftist judges, restricting them only to the parties at hand in lawsuits. That’s a good thing, not that some of those rogue judges are paying attention.
While I confined that article to short-barreled rifles and shotguns, many Americans have considered the injunction an opportunity to buy suppressors without government registration and permission. However, suppressors are still treated like firearms, so a Form 4473 and a federal computer check are still required; there is still a paper trail. At my home blog, I went into greater detail, including listing the parties—which includes 15 states-- technically covered under the injunction. I ended that article with this warning:
So, buy an SBR, short-barreled shotgun, or suppressor now while you can, possibly without being entered into a federal database? Caveat emptor—let the buyer beware. Until the law itself is entirely, nationally, struck down and/or completely repealed by Congress, you’re relying on the honor, word, and ethics of princes and bureaucrats.
That’s virtually always a bad bet.

That was coming anyway. But it does bother me, I’d much rather have the BATFE in “Revenge Mode” by electing a Democrat to assure it happens because my RINO said something mean about Trump several years ago, so I’ll sit out the November Election. It’s a worthy trade as it will make me feel better, ridding the Senate of that HORRIBLE RINO.

The problem at this point is the only reason a suppressor needs a 4473 is the 1934 NFA designates it as a “firearm” regardless whether it is attached to a firearm. And people have “Form Oned” some quite effective suppressors made from automotive oil filters, so the “firearm” designation is absurd. And 4473s means there’s a paper trail, so they need to rescind the NFA or amend it and remove that clause.
I’m doing a bit of guessing here but it appears you still have to “Form 1” a home-made suppressor but there’s no tax. Which seems to be a disconnect because a Form 4473 is not “registration” (the dealer keeps it on file but the Feds have to track them down on a case-by-case basis, and there isn’t supposed to be a national database) but the Form 1 is a formal registration instrument. So the store-bought suppressor doesn’t get registered but the home-made one does.
I should have added to my previous post that it’s still perfectly legal to manufacture all the firearms you want for your own use and neither notify the Feds of your doings or affix a serial number to them. Which highlights another disconnect in requiring the home-made suppressors to be Form 1’d. What call do they have for requiring a Form 1 for a DIY suppressor, which at this point is merely a firearm and not ‘technically’ an NFA device, when a DIY honest-to-goodness firearm requires no such paperwork?

Not really, I fight in the PRIMARIES, rather than handing Democrats the seats they need to destroy the country. But I realize that some here will only vote for perfect conservatives in November elections. I suspect those people don’t have any kids, or they’d have a lot of EXPLAINING to do (or don’t give a crap as to what they’re subjecting those kids to).
This has echoes of the arm brace fiasco. I’m staying out of it until it’s a done deal at the very top of at least one branch.

The Soviets had a tried and proved formula for a successful insurgency. One of the first steps is to break the public's confidence in the ability of the powers-that-be to provide basic services, to include law and order and personal security.
The collapse of law and order makes the sheeple receptive to even the radical replacements, provided the radicals do competent job of selling themselves as the least worst alternative.
By my count there were at least a dozen countries that adopted Communist governments thanks to a Soviet or Chinese-backed insurgency during the Cold War. And another dozen became "Soviet-aligned," meaning they never formally implemented a Communist government but they still were in the hip pocket of the USSR.
And once there's a One World Government, they no longer need the façade of climate change to justify their actions. If they want mass exterminations, they'll have them, and they won't have to hide behind CO2 to do it.
