Jeanine Pirro seeks to drop charges against Olympian David Hearn, admits reflecting pool damage was ‘flawed installation’

DC US Attorney Jeanine Pirro is moving to dismiss charges against former Olympic canoeist David Hearn for allegedly vandalizing the Lincoln Memorial Reflecting Pool, revealing in a Friday court filing that the damage was, in fact, “the result of flawed installation by the contractor.

Pirro’s office submitted the motion to dismiss after Hearn had pleaded not guilty earlier this month to one felony count of destruction of property for the alleged June 19 incident.

Sorry, but WHAT? The guy was RIPPING the lining out of the Pool. How are they going to blame this in the contractor? Can they get this guy on something else?

Jeanine Piro says that the coating was initially improperly installed and was already damaged by a rushed installation in advance of the America 250 celebrations, so they can't prove damage by vandals.

Piro further said that the Department of the Interior initially provide only "bare bones" documentation and didn't give a fuller explanation until after the indictments were handed down.

Now I'm waiting for the Democrats to call for Burgham to resign or be fired, because they will look for any excuse to try to get rid of any Cabinet member that President Trump is close to.

This was doomed from the get-go.

Even without surveillance, the idea that someone or even a gang could somehow tear the lining FOR GREATER THAN THE LENGTH OF A FOOTBALL FIELD is beyond far-fetched. Of course the lining was defective or defectively applied.

Since there were plenty of videos of the blue lining detached and floating, unless there was evidence of Hearn tearing the bottom of the pool (rather than just holding a patch of the lining) there was no way this case would go to a jury.

I blame Pirro for hyping this to the moon.

I think you could see the problems with this case right away. I wrote a piece for New York magazine, and I said on air that there were some reasons to doubt the validity of this case. I did not expect it to unravel so quickly. It’s a real embarrassment, first of all, for the United States’ Justice Department. Let’s remember — first, they arrest David Hearn, they charge him initially, by complaint, with a misdemeanor. Then, they upgrade it to a felony. They get a grand jury to indict him for that felony, and then Jeanine Pirro holds a press conference, where she’s pounding the podium and talking about what a serious crime this is and how justice will be done. And now, it turns out, they dismissed the case voluntarily.

And what DOJ is saying in the statement that we’ve received is that, “Well, we didn’t get the full information about the state of the pool from the Interior Department until after we charged.” But that’s no excuse at all. It’s your job as a prosecutor to get the relevant information first. You don’t charge first and then figure it out. You get the information first and then charge. So, it’s a true embarrassment for Jeanine Pirro. It’s a true embarrassment for DOJ, and they brought it on themselves.

Great job prosecutors. You are supposed to have all the relevant facts before indicting.

The clown show was the USDA, not the judiciary. A judge didn’t close this case. Jeanette Pirro did.

I think that's an extreme example, but if a contractor damaged the carpet during installation and then your neighbor damaged it further, it would be difficult to assess the damage done by your neighbor in small claims court.
