“Operating” is probably a broader catch-all not exclusive to driving a motor vehicle, is my guess. A drunk person on an e-scooter who is creating a disturbance in busy parking lot when nabbed by the cops, for example.

Does “operating” include opening the trunk to grab a beer from the cooler? I wouldn’t be surprised.
