13 is too young to give consent. Also, it’s statutory rape. I predict she’ll walk, either prosecutor won’t prosecute, judge will find no probable cause, or a jury will find not guilty.

I once dealt with an issue similar to this. A 13-year-old girl is a minor not responsible enough to make the decision to allow him in. However, a grown man 18+ is responsible for his actions. If she had plugged him while he was in the house, it would be a clean shoot. If not, it's another reason I'm glad I live in rural Texas.
a 13 year old inviting a grown man in the house has no validity if he is screwing her.
