‘This is not New York:’ Florida HOA relents after pressure mounts over new policy, AG says

After putting pressure on a Florida HOA to change a new rule, Attorney General James Uthmeier announced on Wednesday night that the group had finally relented, according to a report from our sister station in Orlando, WKMG.

Last month, Uthmeier shared a notice that he sent to the HOA, identified as Tradition Community Association, Inc., in Port St. Lucie.

In the initial notice, Uthmeier said the HOA had unanimously resolved that “no person shall carry or possess any firearm or other weapon, whether opened or concealed, on any Common Area owned or maintained by the Association.”

“This is not New York or California,” he wrote. “In Florida, the right of the people to keep and bear arms shall not be infringed.”

Per the notice, Uthmeier argued that residents and guests are considered “invitees” under that law, meaning the HOA isn’t legally allowed to expel them simply for bearing arms.

As such, he demanded that the HOA certify to him in writing by Monday that the rule would no longer be enforced. Otherwise, Uthmeier said, his office would take “appropriate action to enforce the law.”

On Wednesday, though, Uthmeier announced that the HOA had agreed to stop enforcing the provision.

“We are working with the Association to ensure this policy change is permanent and complies with FL law,” he wrote. “For others who’ve reached out about their HOAs, don’t worry, we hear you.”

Carpetbaggers should stay where they came from if they don’t like the rules (or lack of them) where they migrated to. One tried to pull something like this with firearms in a Property Owners Association annual meeting in WEST VIRGINIA and was immediately shut down by the other owners. Besides being a right, firearms are an absolute necessity for safety against wildlife. Go back to your crappy, fascist village or township!

The AG says “this is not New York” but Florida HOA rules can be pretty harsh too. I would not be bragging too much.

An HOA I had, for years, was run by liberal goons. One situation that left me stunned was that the “Board” had chosen to arbitrarily fine one elderly homeowner so much that the HOA now owned the home, on paper, from penalties from not doing something perfectly the way they wanted for just part of a year. The Board had contracted a law firm which allowed unlimited lawsuits and legal wrangling, leaving every homeowner the Board wanted to make up any allegation against, to grossly suffer.

They once ordered me to completely resod my whole lawn. There was no reason given, outside of a notice saying I was out of compliance—with no proof or description about why this was out of compliance. I have the same grass every other home had. Other compliance things, though rare, had a picture that barely supported any action, but I then did the fix, myself.

We didn't want an HOA, but the home was a good buy.

Those Board members finally were dethroned, with their antics on that resodding demand being one of their final wacko years’ items.

And, no, I did not resod.

I do not go in any place that has them. I don’t spend money where I am not allowed to protect myself. I don’t fly for that reason.

HOAs are private organizations and should be free to have any by laws and rules they wish. If someone does not wish to live under an HOA and its rules there is a simple solution. DONT JOIN AN HOA. In a free country that’s how we roll. If someone and a band of like minded control freaks wish to band together then the should have the right to do so.

I cannot fathom why anyone joins an HOA only to complain about it.

We have zoning were I live. We also have areas with no zoning. I choose to live were cars on blocks, refrigerators on the porch, and lean- to additions and pole barns are prohibited. My buddy lives 1 mile away and has no prohibitions except against spreading untreated manure. He loves it. If I want a pole barn I’ll buy by him and not rail against the city and my neighbors.

In many Florida HOA, the property owners are members of the corporation that forms the HOA, which, gain, prevents the HOA from banning guns.

HOAs change management companies all the time. The rules change. Complaints and anti-HOA activism — often leading to ousting HOA boards — are how this particular local political system works, whether or not you can "fathom" it.
