This is about provisions of the Virginia constitution. There is no federal constitutional issue. The Virginia Supreme Court should deny and the US Supreme Court should punt.

The “virgin” part of “Virginia” is anathema to many Democrat/Communist/Jihadists.

The fun thing is that the Justice who wrote the ruling killing the referendum was appointed to the VSC by ... Mark Warner when he was governor. Thank you Sin-Tater Warner.

On a side note I saw a graphic of the Virginia state seal. I cannot post pictures here, but the seal shows a man standing on top of another man with sword in his hand. Roman or Greek looking (it makes little sense as it harks back about 2,000 plus years.) In most versions the sword sticking up looks phallic.

Some versions appear to show a man with big breasts and others a woman as the vanquisher.

I am surprised that this is still the Virginia state seal and flag.

On further research, I see it is suppose to be a woman. Several versions clearly show a man.
The seal of Virginia is the official symbolic representation of the Commonwealth of Virginia, a U.S. state. The state flag of Virginia consists of the obverse of the seal against a blue background. A state flag was first adopted at the beginning of the American Civil War in April 1861, readopted in 1912, and standardized by the General Assembly in February 1950. The standing allegorical female figure of virtue is shown having vanquished tyranny, symbolized by a fallen king at her feet. She has an exposed breast in the manner of classical depictions of Amazons. The motto shown on the seal, Sic semper tyrannis, means “Thus always to tyrants.”

And apparently, some people are offended by the exposed breast which has been on the flag since the civil war. They would not be offended if you think it is a man.
