Your doctor is using AI to write your medical chart. Here’s what to ask before it starts.

One in three doctor’s offices uses an AI scribe that records your entire visit. Most patients don’t know. Here are the 4 questions to ask.

⚡ TL;DR

• AI records your visit at roughly 1 in 3 physician practices.
• AI’s notes go into your permanent medical record.
• Federal law doesn’t require the doctor to tell you. State laws vary.
• 4 questions to ask at your next appointment, below.

From the link -

Ask these 4 questions at your next visit
Are you using an AI scribe today?
What company makes it, and is the audio retained?
Can I see the note before it’s finalized in my chart?
Can I opt out of AI documentation for this visit?

Federal law doesn’t require your written consent. State laws vary. But nothing stops you from asking. If the answer you get sounds like a shrug, that’s your answer. Good doctors welcome the question.

Your medical record is your record. Know who’s writing it.

Recently the SDNY ruled in US v Heppner, that using AI chatbots voids attorney/client privilege. I can’t imagine if that holds upon appeal, why HIPAA requirements aren’t similarly impacted.

Using a cloud based (ChatGPT.com) like services to do this does introduce HIPAA questions.

That said, if a facility has inhouse LLMs to handle it I’ve no problem. Just summarizing a discussion is something AI is very good at. If it means doctors have to spend less time writing and enable more time engaging in actual medical activities, I’m for it.

Very patronizing wording. 90% of the context is stuff I dont remember hearing or is made up by AI

When physicians and other health care professionals use computers and various programs to generate their notes, it is often the worst gibberish imaginable. Hopefully the actual diagnostic acumen and prescribed care is better than the note.

Not worried. My doctor still uses hand-written notes and charts in a manila folder. :-)

Last time I went to see a doctor the real doctor didn’t even look at me. Face was staring at a iPad the whole time.

This will be a problem. My last med visit they wanted me to sign for AI usage but stated I can opt out.

I like the idea of reading prior to it being in permanent record. I’ve read medical notes via AI and some are illegible, misspells,( including name), and facts including age.

As long as they ensure that it recorded things accurately. There are big differences if your medical record has:

If you drank some dang ale, or
You have a hangnail, or
If you hurt yourself hanging something on a nail, or
If you want to hang Nelle because you're mad at her.
