I expect most Judges would be inclined to keep putting any Senior Offenders on probation, as it may be the first time in their lives to have broken any laws of significance.
But what to do, when the Defendant himself keeps asking the Judge ‘No more probation! I belong in jail, long term, probably forever. I am ready, your Honor. My bags are packed and I’m ready to go! My Grandchildren can visit once a year like they already do.”
Almost all Japanese minor crimes like this result in a forced apology and a suspended sentence leading to no prison time.
Elderly shoplifters have always been an issue in Japan, and there’s no automatic jail time.
Honestly many do it for care. There are multiple cultural issues behind this, plus some that exist everywhere for elderly men.
Going In Style.
With AI, this might be the future for everyone. There are so many laws currently on the books, the average professional commits three felonies per day. When AI is tasked with handling all the humans laid off from their jobs, instead of paying a “universal high income” as they age into their 90s, it will be much cheaper to observe these humans for 30 days, arrest them, prosecute, then place them in prison warehouses. On the plus side, AI robot-run human warehouses won’t be half as bad as the old Demonrat filled prisons.
