Elon Musk demands judge’s recusal over ‘support’ of LinkedIn post that mocked him after $2B verdict

Elon Musk is demanding a Delaware judge step aside from a high-stakes Tesla case after she allegedly “supported” a LinkedIn post mocking a $2 billion verdict against him in a separate California case.

Lawyers for Musk and Tesla filed a motion in Delaware’s Court of Chancery seeking the recusal of Chancellor Kathaleen St. J. McCormick from overseeing consolidated shareholder lawsuits, arguing her conduct “create[s] a perception of bias” that taints the proceedings.

The explosive filing centers on activity tied to McCormick’s LinkedIn account following a federal jury verdict in California that found Musk liable over tweets he posted in 2022 about his $44 billion Twitter deal.

The complaint includes a screenshot of a LinkedIn post by Harry Plotkin, a Southern California-based jury consultant who worked with the legal team that sued Musk for securities fraud in San Francisco federal court.

“Sorry, Elon. Sorry, Quinn Emanuel,” Plotkin wrote, referring to Musk and the law firm that represented him.

“Thanks $2 billion for your help in this trial. It was a pleasure working against you. Congratulations to the trial team at Cotchett, Pitre & McCarthy, LLP and Bottini Law for standing up for the little guy against the richest man in the world.”

The filing alleges the post was promoted by McCormick’s account, with a banner above it reading: “Katie McCormick supports this.”

McCormick has denied intentionally endorsing the post, claiming she was unaware of the interaction until LinkedIn notified her she had used the heart-in-hand “support” icon, according to the Financial Times.

She is lying but regardless the ethical standard for judges and lawyers is actually pretty clear.

Even the appearance of impropriety is cause for recusal.

The problem is most judges and lawyers have zero ethics and morals, so they refuse to comply with even this commonsense standard.

That isn't true, but enough fall short and get exposed that it taints the rest in the eyes of at least some of the public.

My personal experiences, yes, it is true.

My opinion is anecdotal, based on the partners and associates of one of the top law firms in DC and the government disability offices, both places where I know lawyers working within, it is indeed true, most have far less moral and ethical fiber than a paycheck-to-paycheck prole.

THIS is the judge that is ruining the DE state chancery court. She is I hate Elon, I hate Trump, I have republicans. Needs to be removed.

A major part of a legal education is to remove any moral sensibility you have from the application of the law.

You make your argument, your opponent makes his, and whoever persuades a jury or a judge wins.

Whether you argument is logically correct, meets the facts or the law, or is just is completely irrelevant apart from whether the judge or jury finds you persuasive.

The fact that we, as a society, turn over so much authority to people trained to be paid liars is a big problem.

So what law school did you attend that gave you this knowledge of what is taught in law school?

Because mine was nothing like that. In fact, tons of people go through law school and don't study trial work at all.

DE’s historic Chancery Court *was* a national treasure. The only court devoted to, and limited to, corporate jurisprudence. With a huge corpus of precedents.

Chancery Court was long a national treasure, supportive of the rules of law and stare decisis in cases affecting the bulk of the Fortune 1000 and more.

With a massive corpus of published precedents to make the law less a roulette spin.

So, of course the woke team has been trying to bend it to their will, forcing it to submit to their oh so vital issues du jour.

Looking at you, Kathleen.

I lament the Court’s vitiation by the woke team. Long term that will chill investment and growth.

Oh wait, public investments of taxpayer money will freely flow to the “proper” uses. Central Planning will be great !

Musk has already won the Delaware Tesla compensation case at the Delaware Supreme Court, only thing left there is the lawyers compensation which is minor.
The Twitter case in SF will be won on appeal too.
Isn’t a whole lot McCormick can do.

Judge in Florida refused.

NEWS: A Florida judge has recused himself from overseeing a lawsuit against @Tesla over a fatal crash after a hot mic moment that Tesla said shows he had prejudged disputed issues in the case and was biased against the company and Elon Musk.
