New Mexico Supreme Court denies appeal request from Hobbs woman convicted of throwing baby in dumpster

HOBBS, N.M. (KRQE) – The Hobbs woman found guilty of throwing her newborn baby in a dumpster has lost her latest attempt to appeal her conviction. Alexis Avila received a 16-year sentence after she was seen on camera throwing her newborn in the trash bin behind a Hobbs shopping center. Three people digging through the trash found the baby alive.

The New Mexico Court of Appeals upheld her conviction last year, but she asked the New Mexico Supreme Court to hear the case. The Supreme Court denied her request, meaning she has to serve her full sentence.

This story made national headlines a couple of years ago. Eighteen year-old Alexis Avila gave birth to a baby boy at home early afternoon of January 7, 2022. Instead of caring for the baby she put him in a plastic trash bag along with paper towels used to clean up the after birth. She sealed the bag and drove to a business dumpster for disposal. Fast forward about six hours to early evening. Two men and a woman were dumpster diving and heard a whimper like a kitten. They open the bag and find the baby near death due to hyperthermia. The woman took the baby to her vehicle while one of the men calls 911. Medics arrive and take the baby to the hospital where he was then flown to Lubbock for specialized treatment. He survived and the father has custody. Avila was found due to video of her dumping the baby. She was convicted of felony child abuse and attempted murder. She was sentenced to 16-years in prison and the conviction was affirmed by the NM Court of Appeals last November.

When I was growing up I believed monsters were rare but somewhere out there.

Now I’ve grown up and learned...they’re not rare.
