EXCLUSIVE: DNC joins Supreme Court voting case, blasts RNC efforts as 'wholly un-American'

FIRST ON FOX: The Democratic National Committee filed a Supreme Court amicus brief Thursday seeking to counter the Republican Party in a major election law case this year — setting the stage for a high-stakes court clash that could determine the fate of millions of mail-in ballots nationwide.

The Supreme Court agreed in November to take up the case, Watson v. Republican National Committee, which centers on states' ability to count mail-in ballots that are received within five days of an election.

At issue is a lawsuit filed by the Republican National Committee and Mississippi GOP in 2024, which seeks to overturn a state voting law that allows for the counting of late-arriving mail-in ballots that are postmarked on or before Election Day, so long as they arrive within five business days of the election. The RNC and state GOP have argued that they break with federal voting laws — a point vehemently disputed by other states and the DNC.

In the amicus brief, provided exclusively to Fox News Digital, lawyers for the party urged the Supreme Court to reverse a lower court ruling handed down by the U.S. Court of Appeals for the Fifth Circuit, noting the dozens of states that currently allow mail-in ballots to be counted, so long as they are postmarked before, or on Election Day. They also noted the long history of mail-in ballots in the U.S, which stretches back elections since the Civil War.

"Throughout this Nation's history, the term 'election' has been universally understood to refer to the voters' act of choosing an officeholder—not to the later administrative acts of receiving or counting ballots," the DNC said in its amicus brief.

It seems to me the real issue is the 5 business day window. I assume ballots are sent to the county seat for totals. 5 business days from postmarked just gives fraudsters (DEMOCRATS) a full week to generate fake backdated postmarked ballots in any quantity they want.

If USPS is too incompetent or too corrupt to move ballots across a single county within 24hrs, that’s a bigger problem.

Rule hould be postmarked plus 24hrs for counting. Outside of that, toss the ballots .

Good points, but add in early voting and it gets even worse. Voting day has turned into voting month before and after, it’s really pathetic that the states have let this happen. It’s also uber-sickening that the feds/SCOTUS even have to step in to slow down this voting madness.

In Maine all ballots cast on site or mail-in ballots must be in the hands of the town clerk by the close of voting. A collector from the town office and a person each party go to the Post Office and collects all mail-in at closing time on election day.

Imagine how inhumane and unjust it was to make people have to vote only on voting day for hundreds of years😎

Besides the ability for rampant fraud to happen with voting month(s), mail in ballots…. The absolute worthlessness of people in todays age that say it is unfair, disenfranchising to require people to show up on election day with an ID, tell that to the farmer who had to hitch a wagon and travel to cast their vote

Florida allows envelopes to be opened and ready for processing so when the polls close the button is pressed and the counting begins. Some states won’t allow envelopes to be open until after polls close which is dumb.

They should be opened upon receipt to allow for correction for an improperly filled out cover envelope. This waiting until after actual voting day results are known is where the criminal fraudsters dwell.

Allowing this ruling to stand should lead to claims of “I left for the polling place when they were open and arrived after they closed. You must count my vote.”

Mail-in-voting is an invitation for fraud. With the exception of shut-ins and military, there should be no mail-in-voting.

Many nations outlaw mail-in-voting because they recognize it opens the door to fraud. Here are some of those nations:

France,   Mexico,   Belgium,   Sweden,   Italy,   Ukraine,   Russia, Japan,   Many Middle Eastern Countries,  Many Latin American Countries

Mail-in voting seems, in general but not always, invitation for fraud. At least in the way the Democrats want it done. They need a certain amount of fraud to win an important election, as they have no real issues to base on.

I don’t see in any way how counting ballots that are clearly postmarked on or before Election Day constitutes fraud. The window for arrival is quite reasonable considering mail service. Now if the law allowed for ballots postmarked after Election Day or counted those within two weeks that would be concerning.

I’d be more concerned with lost ballots, and with states changing their own election laws via court ruling in order to favor one party.

All it takes is one corrupt Post Office worker to work with the Democrats to postmark the fraudulent ballots necessary to overcome a small Republican win. It is unfortunate if someone’s vote is not counted due to the deadline, but if you are voting absentee you should make sure you fill out your ballot and mail it at least a week ahead of time.

I was only addressing the specific issue of postmark date in the current lawsuit. On the larger overall issue of mail in ballots I do think the eligibility of not voting in person needs to be narrowed considerably.
