‘ the Defense Department’
The Hill is waiting out Trump’s term.
I think that’s a mistake
So, any idea what the report says or is it up to SecWar to let us know?
There are no 'illegal' orders... There are only orders and when the commander in chief issues you an order you follow it. If you do not, you are disobeying an order and you can be arrested, court-martialed and imprisoned.
The sHill. What a joke
Article 92 of the UCMJ disagrees with you.
That is why I don’t see how Kelly is going to be convicted. It most certainly will be overturned on appeal. He didn’t specify a specific order. His lawyers will spin this as merely echoing this policy.
This is dumb. OF course there are illegal orders. Shoot your buddy. Give me your paycheck. Steal that vehicle. Kill those children. Hide these narcotics.
Dont be obtuse. Your byline suggests youve heard of Nazis. For some things, I was following orders is not a defense - nuremburg. That said - one must make that decision which may be a matter of moral courage or may be a matter of court-martialing an idiot.
Saying you dont have to follow illegal orders is a truism. Context and the inference that our President is issuing illegal orders is a problem - if they dont name the orders - that amounts to impeding the cohesiveness and discipline of the service that may, by doing so, endanger lives. Squishy and hard to specifically prove/prosecute.
Designed play, obviously, was to point to cartel boat bombing and national guard deployments to spark a color revolution. Both got squashed quickly. The messaging synchronization with the “leaks” that would be fodder for those illegal claims shows clearly a larger, funded coordination in which kelly is a tool. That is the fight that need to be had. Kelly, you are working directly for and recieving money from an enemy of the state (Soros) and funder of terrorism (BLM, ANTIFA) - as such - you are a traitor (not because of the ilegal orders argument) - prosecute him, take all of Soros’ money - contribute it to the national debt.
There are lots of ‘illegal’ orders... But you follow them. If you don’t there will be consequences... If you are willing to ignore those possible consequences you are more than welcome to disobey those orders... Regardless... Whether you think they are legal, or illegal and you do not follow them you’ll likely be ostracized and face some sort of discipline and discharge when you do not follow them.

Absolutely correct.
One of our fellow FReepers (I forgot who) pointed out that Kelly looks like a prick with ears.
And those are some ears.
He urged American service members to break their oaths.
He’s not a Talibani, Chinese ... he’s an elected US official.
Article 15 him.
Yoda
I see the resemblance, but I’m not sure about the ears part.
“Yoda”
I wouldn’t insult Yoda that way.
Clearly you've never been in uniform. Illegal orders are given frequently enough. You're obligated to call them out and reject them. You do NOT follow them, especially if you're the one who's supposed to know better. That would get you in even more trouble. "You knew and you did it anyway? What were you thinking?"
The ones we saw were usually related to unauthorized use of funds or equipment. It wasn't bad intent but ignorance. It was often something goofy involving the color of money between active duty, reserves, or guard. One of the CGOs, SNCOs, or sometimes one of the DoD civilians would go through the regs with the offender. A correction, usually by email, followed shortly.
We had a few illegal orders related to personnel restrictions on leave. No can do. The NCOs would settle down the junior enlisted, telling them to be patient, and sure enough the correction would follow.
I had a sq commander order me to violate a law by putting false information into a document that included a warning at the bottom saying doing so could result in a 5 year sentence. I told him to put it in writing. He backed down but had it in for me for my remaining months under him.
Oh well.
A few years later he was forced to retire or face prosecution. The evidence wasn’t totally solid but he retired.
True
Recall him to active duty. Bust him down to private. Make him run the buffer shining the halls at the Pentagon every morning for a couple years. Maybe he’ll get his mind right.
