Judge dismisses cases against ex-FBI Director James Comey, NY AG Tish James
A federal judge dismissed the Virginia criminal cases against former FBI Director James Comey and New York Attorney General Letitia James on Monday, finding that interim US Attorney Lindsey Halligan was improperly appointed to her position and “had no lawful authority” to secure indictments of either of President Trump’s longtime adversaries.
The humiliating defeat for the administration came 11 days after attorneys for both Comey and James had argued that Halligan had to be confirmed by the Senate after Attorney General Pam Bondi used up her allotted 120-day interim appointment on Erik Siebert, who resigned Sept. 19 after Trump publicly criticized him for not bringing charges against the former head of the FBI.

Whether you’re a noob or an olb, how do you suggest we eliminate our constitutionally devised courts without eradicating our Constitution altogether?
US Attorneys are appointed at the President’s choice … how is one illegal?!
Comey will slide on something. You can bet on that. Even if this ruling is reversed on appeal, this judge will find some other technicality to dismiss the case. That is what he is paid to do.
Trump appointments have been blocked by the Democrats in the Senate. Recess appointments have been blocked by the Republican Senate Majority Leader, who has refused to adjourn the Senate.
The Democrats and the GOPe Republicans are in this together. They all want to keep the old system going. The grift must flow.
Never said eliminate our courts, stop being so dramatic. Martial law can be declared like Lincoln did, he didn’t eliminate the courts.
The left doesn’t care about the Constitution, Obama once complained that it shackles government as if that were a bad thing. Our government has been infiltrated with officials who work to undermine the Constitution at every turn. The criminal justice system and the judicial branch have been compromised, the left has installed judges who do not rule according to law, and states attorneys who refuse to prosecute in blue states. The status quo isn’t going to right the ship.
Stop, stop, stop with Obama. No one is using him or his administration as guideposts of judicial rectitude.
As to Lincoln, his action was questionable at best, but at any rate, in the case Ex parte Milligan (1866), the Supreme Court that ruled that the use of military tribunals to try civilians when civil courts are operating is unconstitutional.
So yeah, if you want to trash our Constitution, have at it.
At ease.
You don’t get to tell people what to think here, unless this has morphed into MSNBC.
Ok, if you want to call what is occurring with our courts system “operating”.
Agree.
I was listening to his radio show after a few fleeting minutes of depression but then felt better because the technicality of who brought the indictments will be overcome by the reality of Comey and James being guilty on the evidence in the next trial.
One example of a signed document with “I live here at this residence” by James when she had insurance records and other documents and also was seen by people as living at the other address means she is guilty. Comey will be whether what he said was a lie or it wasn’t (and it was).
I feel better again.
Halligan’s successor may file new indictments, we’ll have to wait and see. But the dismissal was based in a solid application of the law. 28 U.S.C. § 546 makes that clear.
Nailed it.
Yeah, but usually when I do I get called all kinds of names.
I didn’t care much for Blondi from the beginning. Kash, I was told, was going to be tough as nails, deswampify, and right the wrongs. Yeah, LOL
I was yelled at to just wait. It is almost a year. I wonder when the action happens?
I sure do hope I am wrong.
That pretty well sums it up! 😁
Whoever it was that had the opinion that by 2028, Americans would finally come to the conclusion, and realize that they can no longer vote their way out of this mess, was correct.
Time is ticking away for the Trump admin. Two steps forward four steps back with the courts. Rinse and repeat.
The Uniparty, which is most of Congress, has done nothing but obstruct and go on vacation.
We see people like Swallwell and Schiff who actually plan and announce runs for higher office. They are not in the slightest bit afraid of the Trump DOJ.
Our side sometimes mistakes tough talk for actual action. It makes us delusional. We picture in our minds perp walks and justice being meted out to government crooks instead of the citizens who get in their way. Figments of our imaginations, I guess.
I understand & agree with you, but do we stay the course, or do we move now, and how do you envision that playing out?
It’s incompetent stuff like this that enrages people who are dying for accountability...and never get it. It’s like being a Brewer fan or a Buffalo Bills/ Detroit Lions fan.
Or a Gators football fan.
Or a Republican voter
