A group of Republican Senators is calling for the administrative suspension of D.C. Circuit Chief Judge James Boasberg while Congress considers Articles of Impeachment over his alleged abuse of judicial authority targeting the Trump administration.
Senator Eric Schmitt (R-Mo.), Chairman of the Senate Judiciary Subcommittee on the Constitution, and five GOP colleagues made the request Monday in a letter to D.C. Circuit Chief Judge Sri Srinivasan.
Articles of Impeachment were filed against Boasberg on November 4, 2025, following bombshell revelations that the Obama-appointed judge had signed off on former special counsel Jack Smith’s FBI subpoenas targeting hundreds of conservative organizations and ten Republican members of Congress as part of the Biden administration’s Operation Arctic Frost.
Among the organizations targeted was the Republican Attorneys General Association, when it was chaired by Sen. Schmitt during his tenure as Missouri’s Attorney General.
Schmitt blasted the Biden regime’s secret spy operation during the Senate GOP’s press conference on October 29, calling it potentially the biggest political scandal in the last 100 years— “one-hundred times worse than Watergate.”
“Three days after President Trump announced he was running for president, the system was weaponized against him,” Schmitt said.
Jack Smith, who is notorious in prosecutor world as being a Stalin-like ‘show me the man, I’ll show you the crime’ prosecutor. That’s the guy you appoint when you want to get your political opponent. He’s a dirt bag, and I hope he comes before [the Senate Judiciary] Committee.
[…] He not only went after President Trump, he went after sitting senators. At the time, I was the chairman of the Republican Attorneys General Association. Ashley Moody was also on the executive board. He came after us, and also hundreds of other people who happened to be Republicans in the United States of America.
[…] This was an effort to go after political opponents in America like we have never seen before. It can never happen again.
[…] There has to be accountability. The American people have heard a lot about this, and you’re going to hear more. We should have Watergate-style hearings on this for months. If we’re ever going to root this out, we must be serious about it, and consequences must follow — resignations, firings, criminal prosecutions.
The Republican senators said in their letter to Chief Judge Srinivasan that Judge Boasberg “should be administratively suspended pending formal impeachment by the House of Representatives and, if impeached, an impeachment trial by the Senate.”
The lawmakers laid out their case for Boasberg’s immediate suspension:
“On November 4, 2025, Articles of Impeachment were filed against Chief Judge Boasberg over, among other things, his role in improperly granting gag orders in the “Arctic Frost” probe: “Ignoring his responsibility to wield the power of his office in a constitutional manner, Chief Judge Boasberg granted Special Counsel John L. Smith authorization to issue frivolous nondisclosure orders in furtherance of . . . ARCTIC FROST.” Your court adopted a similar sentiment when it reversed Chief Judge Boasberg in In re: Sealed Case, which found that he had erred by too permissively granting government-requested nondisclosure orders against X Corp.”
“These Articles of Impeachment have received bicameral support. Chief Judge Boasberg’s role in Arctic Frost is not the only complaint levied against him. He is accused of improperly using his role as Chief Judge, on March 15, 2025, to assign himself J.G.G. v. Trump, a case the Supreme Court found he lacked jurisdiction over. And in July 2025, it came to light that on March 11, 2025, “at one of the Conference’s semiannual meetings, Judge Boasberg disregarded its history, tradition, and purpose to push a wholly unsolicited discussion about ‘concerns that the Administration would disregard rulings of federal courts, leading to a constitutional crisis.’”
“There is precedent for administratively suspending a judge pending an impeachment inquiry. The most recently impeached judge, G. Thomas Porteous, Jr. of the Eastern District of Louisiana, was administratively suspended prior to his impeachment while the Judicial Conference of the United States investigated allegations against him of bribery and fraud. As Chief Judge of the applicable circuit judicial council, you are tasked with overseeing the Article III remedial process for the misconduct of the appellate and district judges of your circuit.”
The senators demanded that they updates on the Circuit Judicial Council’s actions regarding the case.
“Given you have not entered an order under 352(b), we assume you are following your duties under 28 U.S.C. § 353, which mandate that you “shall promptly” establish a special committee “to investigate the facts and allegations contained in the complaint,” the wrote. “While this impeachment process proceeds, we must have transparency regarding the actions the Circuit Judicial Council is taking against the judicial misconduct of Chief Judge Boasberg.”
The lawmakers requested Chief Judge Srinivasan provide written responses to the following:
• A status update on the DOJ judicial misconduct complaint filed against Judge Boasberg on July 28, 2025.
• If this judicial misconduct complaint has been dismissed, provide written explanation for dismissing it, as well as any other misconduct complaints against Chief Judge Boasberg that have been filed in 2025.
• If he is yet to act on this judicial misconduct complaint, provide a written explanation for why he has failed to “expeditiously” act upon the complaint.
• If he has formed a special committee to investigate the judicial misconduct complaint.
Senators Mike Lee (R-Utah), Tommy Tuberville (R-Ala.), Lindsey Graham (R-S.C.), Kevin Cramer (R-N.D.), and Bill Hagerty (R-Tenn.) joined Sen. Schmitt in signing the letter.
Boasberg is married to Elizabeth “Liddy” Manson, founder and board member of Virginia abortion clinic, Meadow Reproductive. Manson has donated more than $10,000 to Democrats.
From May 18, 2014 to May 19, 2021, Boasberg served on the United States Foreign Intelligence Surveillance Court (FISC), which rubber-stamped the FBI’s FISA warrants to spy on President Trump in 2016 and 2017.
The judge is also notorious for giving a lenient sentence to the FBI lawyer who altered an exonerating email in June 2017 as part of the FBI’s effort to get a FISA warrant to spy on former Trump campaign aide Carter Page during the Bureau’s corrupt Crossfire Hurricane (CH) investigation.
On January 29, 2021, just over a week after Joe Biden took office, Boasberg gave Kevin Clinesmith what amounted to a slap on the wrist: twelve months of probation, a $100 fine and 400 hours of community service.
The judge’s ruling was far more lenient than the maximum sentence of five years and $250,000 fine for the offense of making a false statement on a government document.
Boasberg also gave J6 provocateur and suspected fed Ray Epps a lenient sentence of probation, despite being repeatedly caught on tape urging Trump supporters to “go into the Capitol” before and during the protest on January 6, 2021.
Prosecutors had requested six months of prison time, but the judge took into consideration Epps’ alleged contrition, and apparent cooperation with “congressional investigators.”
Back in March, Boasberg tried to block the deportation of violent Tren de Aragua (TdA) and MS-13 gang members so he could have more time to consider whether Trump’s use of the Alien Enemies Act was legal. Incredibly, the judge ordered planes that were already in the air to turn back to the United States.
The United States designated Tren de Aragua, the Sinaloa Cartel and other drug cartels as global terrorist organizations on February 19.

A judge has no real power, as defined by budget or forces under his command. He has only a title, a position, and respect. If they had real power they could wear anything they pleased. Instead, they opt for black robes to make themselves appear institutional instead of just “some guy with a gavel.” Once he has been impeached every ruling he makes comes under much more scrutiny. People will make fun of him. His other judges will pressure him to go as his continued presence will damage their power on the bench. My guess is he’ll retire as his usefulness as a political operative will be compromised.

I think the DOJ should file criminal charges directly and try to put Boasberg in prison for a long time. They need to find crimes that can be filed outside of DC, like in Florida.
One of the real problems, the nation must face is the fact that a large percentage of judges were not born in the U.S.A.
