Charges have been dismissed against 15 Republicans who were hit with felony charges by Michigan’s far-left attorney general for objecting to the results of the 2020 presidential election.
The case was one of several brought by state attorneys general in the lead-up t0 the 2024 presidential election. Similar cases were brought in Georgia, Arizona and Nevada after left-wing prosecutors accused them of committing forgery by serving as alternate electors.
Charges against the Nevada electors were dismissed by a judge last year, while Fulton County District Attorney Fani Willis’ case has long been paralyzed. On Tuesday, District Court Judge Kristen D. Simmons dismissed the criminal charges against the Michigan electors, according to a report from the Associated Press.
The judge determined that she saw no evidence of the group conspiring to commit fraud, and that the defendants sincerely believed there were issues with the controversial election. “I believe they were executing their constitutional right to seek redress,” Simmons added.
Each defendant had been charged with six counts, including conspiracy to commit forgery and election law forgery, each a 14-year and a 5-year felony, respectively.“The false electors’ actions undermined the public’s faith in the integrity of our elections and, we believe, also plainly violated the laws by which we administer our elections in Michigan,” Nessel said when the charges were announced in July 2023.
“My department has prosecuted numerous cases of election law violations throughout my tenure, and it would be malfeasance of the greatest magnitude if my department failed to act here in the face of overwhelming evidence of an organized effort to circumvent the lawfully cast ballots of millions of Michigan voters in a presidential election.”
On Tuesday, Nessel called Simmons’ ruling “disappointing” and said her office would determine whether or not her office would seek an appeal. The far-left attorney general doubled down on accused the defendants of attempting to “steal” the 2020 election even though charges were dismissed.
“And if they can get away with this, well, what can they get away with next?” she added.
Following the controversial 2020 election — that saw unprecedented increases in mail-in voting with little to no oversight in most swing states — a number of states commissioned alternate electors to question the results. Alternate electors has historical precedent, including in the 1960 presidential election, when two sets of electors were heard for Hawaii.
Nevertheless, Nessel and other far-left attorneys general arrested several Republican lawmakers and operatives for “conspiring” to commit forgery as part of a “scheme” to overturn the 2020 election.
A case against alternate electors in Arizona is still pending, and state Attorney General Kris Mayes has said she has no intention to dismiss the case.
