There is also the case where an XY has androgen insensitivity, where his body CANNOT process testosterone, and he winds up looking very feminine, and not developing secondary male attributes.

Such unfortunates are really incapable of a valid marriage, but if they want to present as female because they CANNOT credibly present as male, I would give them a pass due to a true physical handicap.
