If congress were capable of doing their job they would have done this by now.

They’re uninterested in doing anything. Half of the Republicans seem to be Democrats.

It's also why it will all be undone in 3 years.

Wouldn't Trump's tariff program require 60 votes in the Senate to pass? Do you really think the Dems would support ANY Trump initiative? And then there are the RINO quislings like Collins, McConnell, Murkowski, and Tillis to deal with.
Given the current Senate, it's unreasonable to expect anything like the Trump tariff program to become law.

Maybe if they were to declare a ‘trade war’, then we’d get to scramble the fighter tariffs..

One thing is for certain, the court system has less say than than any of the three branches. The Constitution grants presidents emergency powers, so how can it be unconstitutional.
It's a tax only upon the importer, and this who choose to buy the imported product that have tariffs levied against it. Tariffs have had zero impact upon me, since I buy American products.

"If congress were capable of doing their job they would have done this by now." Remember the backstabbing performance of the GOP Congress in 2017...
The feckless GOP has one function (in their own minds):
Protect their long-term access to the financial security of being a congressperson, even if in the minority, over any responsibility to the GOP voters who sent them to DC...
