Texas man sues California doctor in unprecedented abortion pill case over unborn child’s alleged ‘murder’

A Texas man has filed a landmark federal wrongful death lawsuit against a California abortion provider, alleging the physician "murdered" his unborn children by mailing abortion pills across state lines.

The case, Rodriguez v. Coeytaux, marks the first of its kind to test how far pro-life litigants can go to sidestep blue state abortion shield laws using century-old federal statutes and Texas civil code.

Filed July 20 in the Southern District of Texas, the lawsuit accuses Dr. Remy Coeytaux of aiding illegal self-managed abortions in 2024, by mailing abortion-inducing drugs to Galveston County, Texas, where they were allegedly used to end two pregnancies.

Plaintiff Jerry Rodriguez claims his girlfriend’s estranged husband purchased the pills from Coeytaux through a Venmo transaction and pressured her to take them, ending two pregnancies Rodriguez says were his.

At the heart of the suit is an alleged $150 Venmo payment to "Remy Coeytaux MD PC" labeled "Aed axes," followed by his girlfriend's name. The lawsuit states Rodriguez interprets "Aed axes" to be a phonetic spelling of "Aid Access," a network that helps women obtain abortion pills.

Rodriguez alleges the first abortion occurred in September 2024, at the home of his girlfriend's mother, and the second in January 2025, at the home of her estranged husband. Ultrasound images from January, attached as Exhibit 2, are offered as proof of a second pregnancy. According to the complaint, the baby was a boy.

Rodriguez is seeking over $75,000 in damages, certification of a national class of "fathers of unborn children," and a permanent injunction barring Coeytaux from mailing abortion drugs in violation of state or federal law.

On one hand I'm glad he is standing up for his child.

On the other hand he should have had better sense and not be with a woman who's marriage was on the rocks and got her on the rebound.

If someone in Texas mailed a weapon to someone in California, after being told it would be used to murder someone, they'd be charged as an accessory to murder.

The "doctor" in California is an accessory to murder.

how far along? Abortion pills need to be used very early in pregnancy: the rule is to use them under ten weeks.... So malpractice might be another problem for the doctor who never examined the lady.

the ultrasound would answer this. And if the Ultrasound showed it was a boy it would have to be at least 11 weeks along (but usually it’s not accurate until 18 weeks or so).

I asked openevidence.com, “ Can misoprostol end a pregnancy at 18 weeks?” This was the response:

Misoprostol is widely used for second-trimester pregnancy termination, including at 18 weeks, and is effective whether the fetus is alive or not. Typical regimens involve 400–800 mcg administered vaginally, buccally, or sublingually every 3–6 hours until expulsion, with success rates generally exceeding 90% within 48 hours.[1-10] Efficacy is slightly higher and induction-to-abortion intervals are shorter in cases of fetal demise, but misoprostol alone remains effective for both scenarios.[2][5-7][11] The addition of mifepristone prior to misoprostol can further reduce the time to expulsion, but misoprostol alone is a standard and effective option.[11] Rare but serious complications such as uterine rupture are more likely at higher gestational ages or with prior uterine surgery, so close monitoring is essential.[1][10][12]”

So. There’s your answer.

Take it 1 step farther...

If a wife ends a pregnancy without the husbands consent... should be grounds for divorce without the male being penilized through the alimony process for decades or unkess the wife decides to remarry. Which rarely occurs.

Be careful what you wish for we have sovereign states for a reason. The federal government mediates between state’s. You don’t want Texas Court’s trying to push state law to California as the reciprocal will be true. California will then have legal standing to go after every firearm transaction, manufacturer, distributors, retailers the works they would use it via lawfare to cripple the firearm industry not just in Texas every other red state. Same for climate change laws that that state has they would instantly sue for co2 emissions and every oil producer in Texas would be in California court in a heart beat.

Don’t get all chest thump just because you don’t like someone’s behavior. The legal system is set up to shield state’s from each other to prevent lawfare. The person at fault is the woman who chose to take the pills, she could just as easily gone to Mexico and taken them there or New Mexico or Kansas. The state no state has the right to limit travel of its citizens that is solely a federal power and only in too the country not out of it. Only people who have criminal Court convictions can have their movements restricted and only for the period of time that the plea deal or parole dictate.

We get it you don’t like abortion change the mind of the woman ,not demand a dangerous legal precedent to suit your emotional needs. The democrats are the kings of lawfare they would use precedent in ways the GOP wouldn’t even dare do and they will win since the courts and judges are in their playground. Very bad idea to give them national standing VERY VERY BAD IDEA.
