If the airline chooses to fight this, rather than some quick money grab, the passenger's going to find themselves on the hook for legal fees. That is if it doesn't get immediately thrown out for failing to meet the threshold for federal court.
Hot tip, if you're in the bathroom, communicate with crew. There's no 'breaking of the lock', crew can unlock the door (or even remove the door from the outside), and rather than a pilot, it might be a sky marshal dragging you down the aisle to your seat with a pair of handcuffs.
If you've got diarrhea, communicate it, don't be mysterious.
Consider more fiber.
No sympathy here. And it was constipation, not the runs, so he should have been able to hold it until they landed. Dude needs to up his fiber intake and drink more water.
X=Lax perhaps?
I cannot imagine wanting to try to have a bowel movement on an airplane. If he’s constipated then wait till you land!
I am not going to read the entire article.
It is pretty obvious the passenger has no leg to stand on.
The courts give the flight crew a lot of leaway when it concerns flight safety.
If the flight crew tells you to return to your seat, unless you are physically incapable, you return to your seat.
If you are not physically able, you inform the crew as to your particular disability and they they will help you return to your seat.
Statements like ‘one minute’ will not get you far.
I didn’t really read the story because it’s kind of boring and I see what the problem . What makes me sick is the picture of the United Airlines 737 in the Continental Airlies livery. That’s the Continental Airlines tail flash. United took that tail flash and turned into a complete utter disgrace. And I can speak from experience.
What difference does it make that he is an Orthodox Jew?
If you’re constipated and being asked to get out of the toilet I don’t see the problem in doing so immediately.
After 9/11, flight crews have to wonder if a barricaded passenger is incontinent and embarrassed or preparing some sort of attack. Federal law is clear that flight safety considerations are paramount, not the bathroom privacy of passengers.
From a number of postings here, it does not seem like many of you have been constipated before. Not to have too much description: it could have been half way out. What do you do then?
First guy ever to return from Mexico constipated!
If this guy gets millions there are going to be a whole lot more constipated passengers soon
United does not screw around. Last flight with them we were parked on the taxiway for 50 minutes and the flight crew kept the lavatories locked. It was a little inhumane I thought.
He’ll sh** for sure when he gets the bill for all this.
They were LANDING!
“... exposing his genitalia to other flyers during a flight from Tulum, Mexico, to Houston.”
His other option was to PULL UP HIS PANTS.
You would think that a stay in Mexico would have given him “Montezuma’s Revenge.”
