Do We Have 677 Unelected Presidents?

There are almost 700 federal district court judges. I say “almost,” because while officially there are 677 of them, some retired judges have taken senior status and may sit from time to time on cases, so the figure is inexact on any given day. Since President Trump was sworn in for a second term, there have been an avalanche of cases seeking relief from executive actions. Last month alone district court judges issued 15 temporary restraining orders. “That’s more nationwide injunctions than there were issued for the first three YEARS of the Biden Administration. District court judges are out of control.“

A Temporary Restraining Order (TRO) is designed to maintain the status quo after a claim is made that there is an emergency requiring the court to maintain the matter in a holding pattern -- usually for 10-14 days -- until a hearing on the issue can be held. A TRO can be granted ex parte, that is with only the plaintiff being present and without a hearing on the issue at all. The plaintiff must show the likelihood of success on the merits of the claim and that the harm to him outweighs any potential harm to the opposing party. To get one, the plaintiff has to show the likelihood of irreparable injury if the court fails to act. After a hearing, the court may issue a Preliminary Injunction (PI) directing some action or continuing the initial restraint until a full trial on the matter is held. To obtain a PI that lasts throughout the course of litigation, the plaintiff must meet a higher standard of proof. “A TRO requires the applicant to show a substantial likelihood of success and immediate harm, while a preliminary injunction involves a more rigorous evaluation of the merits, balance of equities, and public

Yes, and Trump should ignore these rulings. Why on earth is Trump’s lawyers insisting that Trump has to comply with these orders. And I don’t care is the Supreme Court says Trump has to comply with these orders.

Let there be a Constitutional crisis. That is preferred to allowing the country to be destroyed.

the sole goal of judicial impertinence is to hold up our duly elected President from doing what needs to be done in a timely manner until the leftists and their rinoclass cronies can run out the clock. the bought and paid for or blackmailed blackrobe people, who’s names don’t need posting, will do all they can to make sure that happens. they think we’ll thank them one day.

Nowhere in the Constitution are district court judges granted the power to issue nationwide TROs or nationwide injunctions. This is a power district courts simply started claiming for themselves in the 1960s. Personally, I think President Trump needs to just act as though they are not legitimate and ignore them. That would force Roberts to quit stalling and delaying because it suits him personally to see President Trump’s agenda thwarted even though he knows the means used to do so are illegitimate, and have the SCOTUS rule these nationwide TROs/Injunctions unconstitutional once and for all.

We do NOT need imperious “judges” {usually with dual
passports, and from other countries} trying to
‘take down’ the elected President. That is treason.

Decision: Ruled in favor of President Andrew Johnson by finding that the Constitution’s separation of powers prevents the Court from stopping the President in carrying out his executive duties.

This has been decided. I think our current Supreme Court needs to re-affirm. And if they choose not to, THEN you have a Constitutional Crisis.

But it still has control of the Congress, the judiciary, the bureaucracy, and possibly still the SCOTUS.

Be prepared for a long haul, folks, because Deep State is dug in.

Rooting them out is going to take a while.

That’s a very difficult task. And those judges know it - in the entire history of the country, only eight federal judges have been impeached and removed from office.

I’d advise Trump to simply ignore these “orders”. To do otherwise would paralyze the executive branch. Because you can be sure some Obama/Biden judge will try to block every last move Trump makes.

So carry on normally, and let the Supreme Court eventually sort things out.
