Except that they can’t, because they aren’t, just as the Ukraine volunteers who are formally in the Ukraine military can’t be, the North Koreans are regular army forces fighting in Europe.
There are no credible reports of North Koreans fighting in any significant numbers. There are credible reports of Americans fighting with the Ukrainians.

That doesn't seem quite the same. I think the nation of North Korea sent their troops to fight in Russia and they wear their uniforms, so they're not mercenaries. I'm open to corrections.
