The Self Determination rule allowed companies to decide on their own what was safe. I doubt the FDA was involved in this.
The dilemma:
Give the government more control and opportunity for corruption, or
Allow any and all lawsuits against companies.
Neither choice sounds good.

I’m not familiar with said “Self-Determination Rule” as far as manufacturers of foodstuffs and drugs - the FDA is supposed to keep poisons out of food and drugs - yet we have a LOT of serious issues over the decades...and now they have banned Red Dye #3 due to it causing cancer in rats - but the ban doesn’t go into effect until 2027...allowing cancer-causing materials in foodstuffs because “it makes them look pretty” ain’t doing the job...especially when they banned Red Dye #2 in M&Ms back in the 70s...and all companies are required to report to the FDA what they’re putting in their consumables.
