Kirsty Shelton was at home preparing lunch and watching television with her daughters and their grandmother when they were startled by loud banging on their apartment door by a SWAT team looking for a man who lived across the hall.
Shelton's mother told them they had the wrong apartment but, according to a lawsuit filed Tuesday against the Denver officers, she and her daughter were ordered outside at gunpoint.
When the officers then entered the apartment, they encountered two girls, aged five and six, in their bedroom.
According to the body camera footage of the June 2023 incident, an officer told them they could play there and that he would get their grandmother, but the girls began to scream.
Police then put the family, including another adult who had just gotten out of the shower, into a locked police car for about an hour and took over their apartment as they continued to search for the suspect, according to the lawsuit.
It says police knew the man they were looking for lived in apartment 307, not 306 where the Shelton family lived, and that the numbers were clearly marked.
It claims police didn't admit to making a mistake but instead denied the raid ever happened.
The operation's commander wrote in an after-action report that, due to the layout of the apartment building, the family was 'contacted, advised of the situation and evacuated for their own safety,' the lawsuit says.

WHY does it take X Swat officers AN HOUR+ to search an apartment for a full sized human?
Was it 5 minutes to search, then 55+ minutes to come up with a CYA strategy inside that apartment?
Are these the same Denver cops who don’t want to be seen with ICE at the local donut shops? Screw ‘em.
Fire everyone involved (especially the perjuring commander) and deny them any kind of police, security or job with authority.
They’ll never be fired with the lawsuit going.
Otherwise, they’d be free to tell the truth.

This is why qualified immunity needs to go away.
They KNOWINGLY radied the Wrong apartment. Threatened and detained (cuffed and stuffed into a police car) innocent people. Ransacked their home.
then said... “oops, wrong house. You’re free to go”.
I’d sue for $5-to-10M...but I’d demand the crew involved be put on unpaid LV for 30 days, and raids in the future must require the judge himself/herself to accompany the crew.
Yep. After 5 minutes they figured out they fkd up and spent the rest of the time getting their stories straight.
I am in favor of qualified immunity when a police officer has to make a quick decision while under pressure.
This is not one of those times. Every cop involved here needs to be held personally liable. That’s the only way to stop this outrageous behavior.

ALL involved should be prosecuted for Armed Home Invasion, Kidnapping, False arrest.
It sometimes is a lot worse. At least they didn’t shoot anyone.

The “Special” police could not read the correct friggin NUMBER on the Apartment

They tore it apart hoping to find ANYTHING illegal so as to come up with a justification for the raid.
Just wait. There will be plenty of people here defending the cops.
In ALL CASES of Felony Stupid All Criminal Charges should be in play and the entire gang belongs in PRISON for a Minimum of 20 years.
