Our definition of what the death penalty should be used for is FAR too limited. It should be available for ANY crime that injures or damages the victim so severely, mentally or physically, that they can never return to a normal life. When was the last time you heard of somebody riding Ol' Sparky for rape? And AFAIK it's never been used for bilking feeble and too-trusting little old ladies out of their retirement, when they belong to a class of people most deserving of such protections.

Top of the list should be attempted murder of a law enforcement officer. Reducing the penalty because they are inept at murder only allows them the opportunity to practice until they get it right.
