The Supreme Court on Friday rejected an emergency appeal from Republicans that could have led to thousands of provisional ballots not being counted in the battleground state.
The justices left in place a state Supreme Court ruling that elections officials must count provisional ballots cast by voters whose mail-in ballots were rejected.
As of Thursday, about 9,000 ballots out of more than 1.6 million returned have arrived at elections offices around Pennsylvania lacking a secrecy envelope, a signature or a date, according to state records.
Pennsylvania is the biggest presidential election battleground this year, with 19 electoral votes.
In 2020, it was decided by about 80,000 votes.
The case dealt in part with 'naked ballots,' those without a security sleeve that gets included in mail ballots but which some voters may neglect to use.
The Republican National Committee said it could impact 'tens of thousands of votes in a state which many anticipate could be decisive.'
Wrote Justice Samuel Alito, 'even if we agreed with the applicants’ federal constitutional argument (a question on which I express no view at this time), we could not prevent the consequences they fear.'
There weren't any dissents.
The Supreme Court's rejection comes after an intervention by its conservative majority, off its 'shadow docket', that boosted the Republican position in Virginia.
That decision, which the court released without explanation, allowed the state to purge about about 1,600 people from its rolls just a week before the election.

Wait a minute. It’s 9000 votes. Someone left an envelope off of their ballot.
This says nothing about them being entitled to vote.
And it says nothing about who the vote was for. I think this is just kneejerk reflex by the RNC to challenge everything mail-in because they tend to be Dem.
I don’t see the disaster. Additionally, a phone call to the person could verify it was that person who is entitled. This is also about leaving a date off, when the law is the ballot must arrive by end of the evening election day, regardless of what date is written on the ballot.
Seriously, this package of votes were going to be part Trump and more than that, it’s a reasonable challenge and resolution. This won’t move the needle.

I always the very point of a provisional ballot was it was set aside to verify certain information before it was counted. What’s the point of even having them if they count just the same as a normal ballot?

No. But it lets D’s print off tons of illegal ballots (you can buy blank ballot paper online) and send them in that way without the security envelope — so no signature verification. You don’t even know who purported to vote.

And my understanding of the ruling is that these ballots go into the provisional pile. They are not auto counted. They are evaluated as provisional — which means a check for who it is and is the person registered.
This is the whole point. Ballots coming in are checked against registration lists. Now, zealots of the GA 2020 variety can get bulk ballots at bogus addresses and submit them — but that’s not what this ruling is about.
It is about trivial variation from the law. Then they become provisional and are evaluated as all other provisionals. (FYI most provisionals have always been rejected. They usually are not registered)
