I believe it’s the President of the Senate, not the Veep, though they are often the same person. Not expecting a tie, but it might be interesting to watch who might be President of the Senate pro tem.

That’s your opinion. Other people had other opinions including Ted Cruz. I don’t know you but I assume he is a most accomplished Constitutional scholar than you are.

I don’t know why they would write a purely symbolic procedure into the Constitution.

And I certainly don’t know why they would need to immediately pass a law to prevent something that you are claiming wasn’t possible in the first place.

And Mark Levin, too. But go back to 2017 and you will learn that they were saying the EXACT OPPOSITE thing when it was VP Joe Biden presiding over the certification vote for the 2016 election. These people are political partisans, not serious legal scholars, when they make public statements like this.

It wasn't symbolic when they wrote it, but it has effectively become symbolic over time due to circumstances they would not have foreseen. Remember that the Constitution was written before there were any modern communications, nobody in Washington knew what happened in individual states on the day when presidential electors were selected, and it took days and weeks for someone to travel on horseback from to Washington from some of the states.

And I certainly don’t know why they would need to immediately pass a law to prevent something that you are claiming wasn’t possible in the first place.

There are many laws passed that serve only to clarify a matter that had been in dispute in the recent past.

A tie goes to Congress.

In the House they select the president based on a single vote per delegation. The choice would be for the top two EV recipients.

The Senate would vote for VP, with the sitting VP there to break ties.

She doesn’t certify squat.

She would preside over the election in the Senate. The States would “certify” the Electors. Once it gets to the Senate, there is little else to do. Which is what Pence tried to explain, but some people couldn’t actually get through their thick heads.

It will be over in December when the states certify their votes.

The newly-elected 119th Congress meets in joint session on January 6, 2025. They will settle the tie right there. The Republicans will vote for Trump.

We're not sure about the Senate yet.
