The 12th and 22nd seem to make this a non starter. But the Democrats would argue that Obama could be elected vice president, since the laws and constitution are silent on the specific issue of a twice elected president running for VP.

12th Amendment, in part says:

“But no person constitutionally ineligible to the office of President shall be eligible to that of Vice-President of the United States.’

So much for “Plan C”.

Yes, this “professor” neatly avoids the rather obvious— very early Amendment to deal with JUST THIS kind of thing. He cannot serve as VP because he has already served as President, two terms. Cannot do this.

This isn’t an original professor idea— Larry Tribe the looney seems to think it’s ok. Dershowitz should start setting these clowns straight— if he’s honest enough.
