Legal Bureaucrats Infect the Supreme Court

Justice Sotomayor’s reaction to the SCOTUS immunity decision reveals a disturbing development in the nation’s ultimate Constitution-interpreting body.

“You Americans, you are so naïve,” Joseph Brodsky, a Soviet dissident who was also a Nobel laureate in literature, is supposed to have said to students of his at Columbia sometime in the seventies or the eighties. “You think evil is going to come into your houses wearing big black boots. It doesn’t come like that. Look at the language. It begins in the language.”

For people who take an idea like this seriously, the twelve hours following the release of the Supreme Court’s immunity decision might have served as a confirming event. Not only did justices, journalists, and politicians who objected to the decision systematically use language to misrepresent its empirical reality. In the process, they illuminated a new trend involving language and American law that threatens the republic.

Despite the extreme language used to describe it, the Court’s decision was simple. It did not expand the president’s constitutional authority or turn him into a king; the president remains checked by Congress, which can impeach him, and the Supreme Court, which can overturn executive orders. The decision simply disentangled criminal law from constitutional law by saying the president cannot be checked in his constitutionally mandated duties by a criminal prosecution or the threat of one. It also said that the president’s actions can be prosecuted criminally should they not be specified in the Constitution and should they fall “within the outer perimeter of presidential duties.”

The vagueness of this last phrase earned critiques from Justice Barrett, in a concurrence, and Justice Jackson, in a dissent. But the deeper split between the three liberal justices (Sotomayor, Kagan, and Jackson) and six conservative ones (Roberts, Thomas, Alito, Gorsuch, Kavanaugh, and Barrett) was clear.

We need everybody on the SCOTUS to hang in there for about 6 more months. Then the danger will have passed and President Trump can nominate some good young rock ribbed Constitutionalists to fill any vacancies on the court.....which will hopefully include the Wide Latina.

Question, what has been done before this ruling to stop any of Biden’s “illegal” actions? Come on Libs, name just one! Nothing has stopped the Obama agenda, not even court rulings!

irony being that the only reason why Biden has not been indicted & convicted for unofficial acts taken before he was president is because of his presidential immunity! The special counsel even said so, and the FBI stopped investigating him for other crimes as soon as he got into the race in 2019 because, they said they did not want to interfere with the 2020 election. Funny how Democrats had no problem interfering with the 2020 election, though, when they impeached Trump to cover up Biden’s crimes as they falsely claimed that Trump stole the 2016 election and now was trying to steal the 2020 election by extorting Ukraine to “make up dirt” on Joe Biden.
And Democrats had no problem with extorting the 2020 elections by Stalinist Covid19 shutdowns and communist BLM race riots against capitalism & the cops who protect cazpitalists life, liberty & property—when they said openly that neither would be ended “until Trump gets voted out of office”.

If Trump wins the White House, first thing he should do is arrest every liberal DA for accepting dark money donations from a source outside the country.(Soros) Them prosecute them to the fullest of the law, with long prison terms for their role in being a domestic enemy of the state.

Then go agency to agency and do the same thing. I would go so far as to polygraph every federal employee to see if they are part of the Soros cabal. Those that refuse to be polygraphed are immediately discharged from all their duties , losing all their benefits. Those that test and fail are immediately arrested for insurrection, and those who pass are promoted and tasked with the reorganization of their respective agency.

If Biden is forced out and she is president until Jan 20th, you’re right, she won’t select conservative justices.

That’s why I’ve said everybody on the SCOTUS needs to hang on for 6 more months.....cuz she ain’t gonna be in the White House after Jan 20th of next year.

SCOTUS issued an opinion which is sufficiently vague that they judge everything case-by-case. If they don't like something a president does, if it is too political, they will label it in the outer perimeter of presidential duties. It's what they do: make a subjective determination while declaring it law.
