Stevens wrote for the Court, in an opinion joined by Kennedy, Souter, Breyer, and Ginsburg. There were two dissents. Roberts wrote a dissent as to the issue of standing (i.e., arguing that the Commonwealth of Massachusetts had failed to demonstrate standing), in an opinion joined by Thomas, Scalia, and Alito. Scalia wrote a separate dissent, on the merits of the case, in which Roberts, Thomas, and Alito joined.
