Stevens wrote for the Court, in an opinion joined by Kennedy, Souter, Breyer, and Ginsburg. There were two dissents. Roberts wrote a dissent as to the issue of standing (i.e., arguing that the Commonwealth of Massachusetts had failed to demonstrate standing), in an opinion joined by Thomas, Scalia, and Alito. Scalia wrote a separate dissent, on the merits of the case, in which Roberts, Thomas, and Alito joined.
Oh FJR dissented!
But we know, these dissents are traded like cards where they take turns
Thanks.
Souter, the choice that continues to give.
