Don’t know the legal answer, but given what’s going on with Trump, I say he will pardon if necessary. If it’s not legal, no one will stop him.

If there’s any real danger to Hunter, Biden will pardon him before or after the election. He’s arrogant enough to believe he can get away with anything. Even if staff pressures him about election affect, he won’t believe them and will assume any father will be understood to protect any son, especially one left behind after the death of his poor brother. Biden wonders if he ever mentioned that.
