Thirty tears ago while driving at night, a pothole broke my axle, costing me $500+ (although not apparently damaging my brain). So I sued the county in Small Claims Court.

When my case was heard, the County’s lawyer simply raised “assumption of risk” as its defense—that is, by using the road I had taken that risk upon myself. The judge agreed and found for the County.

A town in the midwest, figured out how to fix potholes, long ago:

Move the potholes into the path most used by the Mercedes Benz vehicles of the judges and lawyers.

Our small city had one on a major street that went to City Hall, the Police station, The CHP Station, and the Hospital. There was a Denny’s Restaurant along it where truck drivers would park along the curb to eat. The city refused to fix it. It was there for many many years. Then on our prom night four of my friends were leaving prom and hit the pothole in a VW beetle. It threw them to the right towards the curb and they ran right under the back of a parked semi trailer. Decapitated all four instantly.

In a tight vote the city finally voted to fix the pothole.

No matter what the circumstances or who does it, there is indeed something to holding city hall accountable for neglect. Every year thousands are injured or killed by neglected potholes.

Maybe if she had worn her seatbelt and been a more careful driver, she would not have suffered the head injury from when the was thrown out of her seat into the roof of her car. But like everything else on the Leftist Coast, it is 100% someone else’s fault.

I will assume that if the Judge / Jury finds for the plaintiff, that they too have driven over the same pothole and received the same sort of brain destroying injuries.

I was riding in the back seat of a car that was going at a relatively low speed. It went over a pothole, and I immediately got a headache that lasted for about a month afterward. My eyes and ears weren’t right for about the same length of time. I could be tempted to believe her

When do you ever see a pothole from a distance? They are never visible from more than a quarter block ahead.

But this is Portland and that explains the pathetic status of the person and the street. Since Portlanders typically wear masks indoors, I do wonder why she wasn't wearing a helmet.

That’s about three miles from my parents’ house, and about two blocks from where I would hitchhike south on I-5. The roads weren’t too bad back then.

The photo looks like a decent pothole, but I’ll bet she was driving way too fast and probably yakking on her cell phone, so of course she couldn’t be expected to steer around it.

Heck, I would lose all my arms and lets and my head, if I drove over a pothole in a $10 million lawsuit.
