Thirty tears ago while driving at night, a pothole broke my axle, costing me $500+ (although not apparently damaging my brain). So I sued the county in Small Claims Court.
When my case was heard, the County’s lawyer simply raised “assumption of risk” as its defense—that is, by using the road I had taken that risk upon myself. The judge agreed and found for the County.

Maybe the manufacturer is liable? Shoulda build cars using F-350 axles.
