Checkmating DoJ and Jack Smith

The higher courts are finally stepping in to limit the legal overreach evident in both the J6 cases and Jack Smith's jihad against President Trump.

This week all eyes were on the Willis-Wade fiasco in Fulton County, Georgia, but three less smuttily scintillating cases seem at last to be limiting the overreach of the Department of Justice respecting the J6 defendants and Jack Smith’s persecution of President Donald Trump. In interpreting criminal statutes, it seems to me that Courts should not be creative and expansively read into them things that the legislature which writes the laws did not clearly proscribe as illegal, and it appears that finally, courts higher than the highly partisan D.C. Circuit judges understand that.

The J6 Defendants

If you have been paying attention at all, you are aware that hundreds of peaceful January 6 demonstrators at the Capitol have received draconian punishments and, as Julie Kelly so assiduously reports, are being very badly treated in confinement. A few have even committed suicide because of their treatment at the hands of the D.C. Courts and the prosecution. Two cases signal that as many as 100 or more of them will have a pathway to obtain reduction of their sentences. As I will explain, these cases and the Supreme Court’s grant of certiorari in response to a Trump motion for a stay, may well result in a major loss to Special Counsel Jack Smith and those counting on a jail term for Trump being a vehicle to schlep the demented President Biden over the finish line for a second term.

All the J6 defendants who pleaded guilty had to agree not to challenge the levels of sentence enhancement the DoJ said were applicable. Those who refused the plea deals and went to court (a lesser number) were given...

Once again, the press msidirect the public ire to the wrong thing. This isn't finding out about an affair between Bogart and Becall. Those details no one wants to know in this case. The horror is tha obvious self-dealing using public money and perpetuation of a case to continue self-enrichment. It's 10% for the big guy all over again, this time directl affecting the so-called justice system.

It's that Trump is being attacked by a bunch of self-dealing incompetent psychopaths who hold positions of power and no one will stop them. Incompetence. The nature of lawfare is that regardless of the outcome, great damage is done, and cannot be undone. Justice, if it comes, is expensive and slow, often ruinously so.

I’m glad a light has been thrown on the unjust treatment of the J6 freedom fighters. Every judge and prosecutor in the DC court system who have perpetrated this travesty of justice should be disbarred and jailed. Also I hope someone files a suit based on selective prosecution. Not one DC BLM rioting arsonist looter was put in jail while J6 protesters received cruel and unusual punishment and their 8A rights trampled.

Two points not mentioned by the author:

1. The main reason for the draconian punishments given to the J6 protesters is to intimidate all Trump supporters. The Democrat DoJ is dedicated to scaring us into meekly going along with their dictatorial actions without resisting.

2. No President in the history of the United States has been prosecuted for actions done within their time as President. The simple reason for this is that Presidents must have the ability to make tough and controversial decisions and not be watching over his (or her) shoulder while making those decisions. Thanks to this idiotic set of judicial attacks on President Trump, Pandora's Box is now open - forever - for every single President to know that the other party's judges are waiting for them when they leave office.

Democrats are really lousy at predicting the consequences of their actions.

This 100% needs to be done. Even if it is done, this episode of “American Justus” will forever be a stain on our republic, however long that may be.
