Texas man shot, killed after stealing BBQ pit from owner: authorities

A Harris County, Texas homeowner shot and killed a man after he allegedly stole a BBQ pit from his home early Sunday morning, according to officials.

Harris County Sheriff Ed Gonzalez said in a social media post early Sunday that deputies responded to the 15000 block of Ralston Road near Kentington Oak Drive after reports that a man had been shot and was confirmed dead.

A preliminary investigation revealed the dead man allegedly attempted to steal the shooter’s BBQ pit from his home.

After discovering his grill had been stolen, the homeowner left his home and chased down the suspect in his own vehicle, Gonzalez said.

When the homeowner caught up with the man who was fleeing with the BBQ pit, just a short distance away, he confronted two individuals inside a vehicle.

The man told police he believed the driver of the suspected vehicle was possibly in possession of a weapon.

Gonzalez said the homeowner feared for his own safety and fired his own gun at the suspect, striking him.

The second person in the vehicle was not injured, the sheriff said, and has not been charged with a crime.

Seriously, I have no sympathy for the thief and I have no animus for the man who took action.

It’s a matter of practicality. If you chase down a robber and kill him you should get a medal, but it’s more likely that you will get charged with some criminal offense ranging from manslaughter to murder depending on what jurisdiction you’re in and whether or not you have an anti-self defense zealot as a prosecutor. At the very least you’ll have to hire a lawyer which is going to cost more than a BBQ grill.

Texas observes a version of what is commonly known as the Fleeing Felon Rule.

Declare the act of fleeing law enforcement a felony and shoot the fleeing felon. Works for me!

That’s what I figured... actively chasing the perp down to force a confrontation, claiming stand your ground (I thought he had a gun/felt threatened) seems an impossible argument to make.

Sorry, but I doubt it.

The owner pursued the perp and forced the confrontation, claiming stand your ground (I felt threatened/thought he had a gun) really isn’t going to likely fly, even in Texas.

As I said, we shall see.

Its hard to claim self defense, when your actions created the confrontation... this shooter went out of his way to create the confrontation, he chased the perps down and forced the confrontation. I really don’t see how a “stand your ground” type argument (I felt threatened/thought he had a gun) is going to fly in this case, even in Texas.

We shall see.

We shall see, I got no dog in this fight, but when the shooter is the one actively creating a confrontation, I find it difficult to believe a stand your ground/thought he had a gun argument is going to work, even in Texas.

I don’t doubt how serious anyone takes things, I’m just not sure you are going to get away with a I felt threatened/thought he had a gun/stand your ground type defense, when the shooter actively created the confrontation situation.

We shall see. Got no dog in the fight, but I think, even in Texas this shooter is going to wind up in trouble.

Hopefully some law and order jurors will ultimately acquit the homeowner of all charges. Unfortunately he will pt e charged with murder or manslaughter.
