Another great article by Joseph DeMaio re Nikki Haley's lack of constitutional eligibility for the office she seeks. She is not a "natural born Citizen" (nbC). Her parents were not U.S. Citizens when she was born in the USA. She is an 8 USC § 1401 "Citizen" at birth. But she is not an Article II Section 1 Clause 5 "natural born Citizen" at birth. Read the well argued article by Joseph DeMaio for more on why that is a key Natural Law point in the Presidential Eligibility clause of our U.S. Constitution to minimize the chance of a President and Commander in Chief of our military having dual allegiance, allegiance to a foreign country in addition to the USA, at birth. The founders and framers wanted no foreign influence at birth on a future Commander in Chief of our military. The nbC term is a national security term. We have all seen what happened when the constitutionally ineligible Barack Obama was allowed to usurp the office of President and Commander in Chief, and is being allowed via "Team Obama" to continue to ruin the country as Biden's puppet-master.

You’d have more success keeping Haley off the ballot by criticizing her actual policy positions than by taking another L on the subject of birthright citizenship.

If it means that much to you, advocate for Congress to introduce a statute, or for a Constitutional amendment, to codify the definition of “natural born citizen” that you desire. Because as it stands, current statute/court precedent is overwhelmingly stacked against you.

Well, we can start with the fact that this is a dead issue. Obama was already sworn in as president by the Chief Justice of the Supreme Court - that isn't a legal ruling, but it does indicate how unserious this entire line of objection is. It's obviously fun for a few folks on FR to fulminate about, so have fun - but don't for a second think that anyone who will decide the issue agrees with you.

There are excellent reasons never to vote for Nikki Haley, and I have no intention of doing so - she's Romney as a woman. The fact that her parents weren't born in the US isn't one of them. At the least, I hope this means that Trump is not considering Haley as his VP nominee. But who knows - I wouldn't be surprised if he still did.

Most of my mid-70s HS classmates could tell you who is and who isn’t a natural born citizen. Civics was required to graduate. Sadly, I’m sure many of them voted for a presidential candidate that failed to meet both the letter and the spirit of the Constitution.

Where to start, where to start?

At the beginning.

George Washington had parents who were not citizens. So did Jefferson, Madison and Monroe. That makes eight of the first nine terms served by one who had one or two non-citizen parents. With an alien father, Chester Arthur served as both Vice President and President. With alien parents Obama served two terms as President and Harris has served one term as Vice President. That is thirteen times someone of alien parentage was sworn in as President or Vice President.

Neither the provision which required natural born citizens, nor the provision which created an exception for those who were citizens when the Constitution was ratified, said a word about the parents with regard to eligibility.

As the eligibility clause said nothing about sex, women ran for President decades before they were allowed to vote.
