Texas sued over new immigration law

The state of Texas is facing a lawsuit over a new law that allows state and local law enforcement to arrest people who enter Texas illegally.

Texas Governor Greg Abbott signed Senate Bill 4 into law in Brownsville on Monday.

"We expect a dramatic drop well over 50%, maybe 75%, of the people coming across the border illegally will stop entering through the State of Texas," Abbott said Monday.

On Tuesday, the American Civil Liberties Union of Texas, the ACLU, and the Texas Civil Rights Project (TCRP) filed a lawsuit in an Austin federal court to challenge the bill.

The lawsuit, filed on behalf of El Paso County and two immigrant rights organizations, names Texas DPS director Steve McCraw and Bill Hicks, El Paso's district attorney.

The suit asks a judge to declare SB4 is "unlawful in its entirety" and to prevent enforcement of the new law.

"We’re suing to block one of the most extreme anti-immigrant bills in the country," said Adriana Piñon, legal director of the ACLU of Texas.

SB4 creates a state crime for illegal entry from a foreign nation. It would allow state and local law enforcement officers to arrest people who illegally enter, or re-enter, at the border.

The language of the bill says if the migrant is detained they will appear before a judge.

Under the Texas law, migrants ordered to leave would be sent to ports of entry along the border with Mexico, even if they are not Mexican citizens or they could face time in jail.

Dallas County leaders opposed the bill, saying it could lead to overcrowding of jails.

"It opens the door for the potential of biased policing," said Dallas County Sheriff Marian Brown back in November.

The ACLU and other plaintiffs should be required to put up a Bond for the amount of money that State will incur to service Illegal Aliens for a whole year, and if the Judge says NO, Begin Civil Asset Forfeiture proceedings against ALL Federal Employee’s in the State to pay for it.

It is a Federal Problem right, MAKE THEM PAY by Force if needed.

It is not “virtue signalling.” It is a very smart, no-lose move by Texas. Even if it is struck down, it will expose the democrats for what they are, and help win elections.

It's only immigration when they come through a valid entry checkpoint with the proper documentation.

Concur; those illegals will just enter through the Arizona border, overwelming the system here.

Better yet, Arizona should copy and enforce this law. Force the illegals over to California.

I see many different ACLU ads on late night TV. They are horrible! They spew that “We The People” means “ALL The People”. Video running behind the narrative shows freaks and foreigners, as if they were what the Founders had in mind when writing the Preamble.

Corrupted courts will never allow Texas or any other state to defend the border against this invasion.

See, this is the problem. Texas doesn't need permission from anybody to protect their borders. Allow? The "courts" can go eff themselves!

Mexico is under no international obligation to accept an alien that is not a Mexican national. They will turn them around and refuse them entry even though they were in Mexico just a few hours ago.

The US and Canada do the same thing. If an alien from Russia crossed illegally from the US into Mexico or Canada and they tried to return them to our port of entry they would get refused entry.

Them's the rules.

What a country we have. One where the Federal government not only doesn’t the laws, but helps people violate them. Then when States try to enforce the laws they are taken to court not only by the Federal government but leftist organizations as well. And what happens, Leftist judges side with those not enforcing the law. Judges then wonder why they have zero credibility with most of the American people. Although, to that last point, those judges are so wrapped up in their Leftist ideology that they don’t even think about their credibility.

Watch over the next few weeks how the same people who genuflect over the 14th amendment section 3 will ignore or dismiss Article I section 10 clause 3 and Article IV section 4.

Article I section 10 clause 3

No State shall, without the Consent of Congress, lay any duty of Tonnage, keep Troops, or Ships of War in time of Peace, enter into any Agreement or Compact with another State, or with a foreign Power, or engage in War, unless actually invaded, or in such imminent Danger as will not admit of delay.
Article IV section 4

The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence.
