It’s out of order. He needs to appeal his Minnesota conviction first through the Minnesota Supreme Court, have that overturned or denied, and then bring that case through the Federal appeals process. If the State charges are tossed the basis for the Federal ones goes away.

If the State charges are tossed the basis for the Federal ones goes away. Yes, because it's far more important that our "system" follow a process than that it dispenses actual justice.
Our courts are a ritual. They work about as well as African witchdoctoring.
