Fake Nudes of Real Students Cause an Uproar at a New Jersey High School

After boys shared faked pornographic images made of female classmates, both the school and the local police began investigating

When girls at Westfield High School in New Jersey found out boys were sharing nude photos of them in group chats, they were shocked, and not only because it was an invasion of privacy. The images weren’t real.

Students said one or more classmates used an online tool powered by artificial intelligence to make the images, then shared them with others. The discovery has sparked uproar in Westfield, an affluent town outside New York City.

Digitally altered or faked images and videos have exploded along with the availability of free or cheap AI tools. While celebrity likenesses from Oprah Winfrey to Pope Francis have drawn media attention, the overwhelming majority of faked images are pornographic, experts say.

The lack of clarity on such images’ legality—and how or whether to punish their makers—has parents, schools and law enforcement running to catch up as AI speeds ahead.

The high school confirmed the incident in an email to parents, but a Westfield Public Schools spokeswoman declined to provide details on the number of students involved or to confirm whether any disciplinary action had been taken, citing student confidentiality.

Some Westfield parents said their daughters have felt humiliated and powerless, and worry about damage to the girls should the images surface later. And they are upset that no resolution is forthcoming.

Even among parents, there is no consensus. In a local Facebook group, some called for harsh punishment for whoever created the images. Others deemed it a youthful transgression that should be forgiven.

The debate and its aftermath are likely to continue for months. Westfield police are investigating, and a state senator has asked county prosecutors to look into the case.

A screen shot isn't very good evidence in a court of law.

Agreed. Not great evidence at all. Terrible evidence in fact. But I've heard the advice "take a screenshot of those texts" in things like stalking-related matters for quite some time.

It does, at the very least, obfuscate proof as to whether AI was used in the first place.

In this instance, say the kid texts out the AI generated images. Bunch of other kids take screenshots of them. Unless you track down the originals, you can't really prove that the source image was AI generated.

There are already AI pictures of every major female celebrity that you can think of.

The technology is improving, but it's been done for decades. Most images of models used for commercial purposes are “airbrushed” to make the models look slimmer, have better skin etc.. This is to improve the public's perception of the product being sold.

I guess what crosses the line with this story is that these are not celebrities getting paid for their image where as they say “there is no such thing as bad publicity”(eg Taylor Swift)

These are teenage girls at a high school in everywhere America. Most of these girls are mentally fragile. Just more of the bad part/evil associated of SOCIAL MEDIA.

Maybe in the past that would work, but today, the boys will just say they are women, then compete against them and beat the crap out of them AND have the approval of administrators, legislators and silent parents and girls.

And it won't be long before AI can cause anybody to be "pornified".

It’s already here.

There’s AI programs you can use that will generate extremely convincing nude photos from any clothed photo. Undoubtedly, that was what was used in this story. And the AI tech to generate fairly convincing live action video is improving quickly.

I watched a video on Edgar Cayce long time ago and the one thing he predicted was our machines would turn on us. At the time I was thinking, what is my table saw going to chase me, is my blender going to turn on at a bad time, is my lawn going to eat my foot. With computers becoming more integrated into everyday life and we become more and more dependent on them AI could really make our lives very difficult.

AI can do that now; you only need a small voice recording of the victim.

Appropriating a person’s likeness could easily be a tort, but appears not to be criminal, especially if the nude bodies are AI and not actual photographs.

If the AI picture started as a real photograph, then it would be considered appropriation of the original work product of the person who took the picture. See Andy Warhol Foundation For The Visual Arts, Inc. V. Goldsmith Et Al., Supreme Court of the United States, No. 21–869. Argued October 12, 2022—Decided May 18, 2023

As to whether they fall under the SC’s definition of obscenity, they do not as non photographic material was not part of the obscenity case.
