Can Section 3, Amendment 14 be used to remove appointed and elected government officials who are aiding the Mexican drug cartels with a porous southern border ??

Section 3, 14th Amendment - “ No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, OR GIVEN AID OR COMFORT TO THE ENEMIES THEREOF”.

Being that Mexican Drug Cartels are making Billions of dollars in profits from human and drug smuggling across our southern border. Those smuggling operations have achieved record success in the last two years directly resulting directly in the deaths of American citizens and severe economic and social stress on various state and local governments and their citizens.

And being that it is common knowledge and popular opinion that these drug cartels are openly enemies of the United States and that the intentional actions or purposeful inaction by various Federal civil officials and elected representatives have facilitated Cartel smuggling operations to a level never before seen, is it not reasonable to believe that these same Federal Civil and elected officials have knowingly provided aid and comfort to enemy drug cartels by way of legislation, encouragement, intentional lack of enforcement of existing laws, hampering of local and state attempts to enforce U.S. immigration laws and tacit approval of the untenable situation at the southern border. And that these same Civil and elected officials have knowingly and purposefully ignored expert advice and warnings from law enforcement and immigration experts in regards to measures to secure the border. And that these same officials willingly and purposefully approved the dismantling or cessation of physical barriers and other programs that had proven highly successful at combatting smuggling in the past.

Therefore is it reasonable that Civil and elected officials subject to the removal criteria in Section 3 of the 14th Amendment be immediately removed from any and all offices under the United States and banned from holding any future offices under the United States unless Congress by 2/3rds majority votes otherwise ?

Since Section 3 of the 14th Amendment is in the news, perhaps it is pertinent in the current border situation. For discussion.

Section 3 is what they’re trying to use to keep Donald Trump off the ballot by saying he engaged in insurrection. Section 5 requires Congress to enforce by legislative action (18 U.S. Code 2383) which I believe goes back to the 1860’s. Also, to the best of my knowledge, none of the January 6th defendants (including Enrique Tarrio) have been charged, let alone convicted with it. If Trump cannot be kept off the ballot because he wasn’t charged and convicted under this, you very well can’t go after other elected officials with Section 3 of the 14th amendment either.

The Section 3 thing is something Andrew Wilkow has been bringing up on his show for the past couple of weeks.

I’m not a lawyer but it seems like you need a conviction.

BTW Trump is not charged with sedition or any such crime, so Trump’s case probably doesn’t apply.

Have no idea whether the 14th could be used elsewhere but it is pointless with a corrupt, do-nothing GOPe both a state and fed level. Then you have the issue of commie libtard justices that would toss anything and everything they encountered. Nice idea though.

Firstly one has to be charged with insurrection and found guilty. Even that isn’t enough. Congress then has to pass legislation to make it so but why wouldn’t that be a bill of attainer which is strictly prohibited by the Constitution?

The 14A talks about “insurrection or rebellion”. But no relevant body has declared an insurrection or rebellion. Not the president, not the Congress, not a convention of the states. Even the “thereof” part refers to an insurrection or rebellion.

To use the 14A otherwise means it could be used against literally anyone.

“You called a meeting, then said some very bad things about the federal government. We think you are trying to incite a rebellion. You are therefore barred from holding any state or federal office.”

I always thought of the 14th as the homosexual marriage amendment. It does say that you know.

Could it be interpreted to punish anyone the government doesn't like?

Insurrection and rebellion are just parts of Section 3. My point regards what comes after that which is “or given aid or comfort to the enemies thereof.”

The cartels also rob the buses carrying the border crossers up from Mexico. People will be carrying all the cash they can to have when they get to the border to help get established in the US, but the cartels take everything they have.

The elected officials and their bureaucrat Renfields are rebelling against the constitution by refusing to secure our nations borders. That should be tried. Cause we can’t charge them for failing to keep their oath about following the constitution and the laws. per a court case several decades back where the black-robed commie said they couldn’t be held to it.

I have made the argument on this website that Section 3 of the 14th Amendment does not cover the Presidency. The President is not specified in the section (only Electors of the President) and the Presidency has never been considered an office UNDER the United States so I believe the Presidency is exempt from this section.

When Section 3 was written in 1865/66, no ex Confederate was running for the Presidency. They were running for the Senate, Congress and various other less significant Federal and State offices and that is what the Section was written to countermand.

The problem you get into is there are no lines, no US and its enemies. Everything is blurred. Are the Cartel our enemies? Who is us? When DEA Agent Kiki Camerena was caught by the Cartels, CIA sent their own interrogator down there to work him over, so the Cartels are often assets of CIA. Is CIA US government?

The problem you have is the Cartels are our enemies, but we are just citizens. The Cartels are not the enemies of the Bidens, not the RINOs in the Chamber of Commerce or their elected Lackeys, for whom they are providing a vital function bringing in migrants, not the NGOs getting millions from Congress to resettle migrants.

None of you guys grasp, the government was infiltrated and taken over by a hostile foreign intel op, which has recruited about 10 percent of the population, and is running them against you as a Stasi-like intelligence service. See my tagline.

We are way beyond the point anybody is going to appeal to Mark Levin, who is one of the assets operating against us. We are way past the point of legal arguments, or laws, or court cases. We lost the government, both republicans and Democrats.

This is heading to one place, and unlike the last time, when we left the King’s intelligence network in place to rebuild, we need to be sure we purge the intel network this time.

You can quibble all you want. In my case there is nothing more I despise than quibblers. Six months from now you’re going to look back and say why didn’t we do something sooner.
Time has passed, folks.
When a structure is so rotten it cannot be saved it needs to be dismantled, or burned to the ground. You know what that entails; if you don’t, you need to find another reality. In the meantime carry on quibbling.if It will give you something to do until next March. By then all the shelves in the stores should be empty.
